MAY 6, CONGRESSMAN WHALEY’S SWAMP DRAINAGE BILL Believing it would be otmuch interest to many readers we are reproducing herewith Congressman Whaley s drainage* bill intro duced in the House of Representatives on April 25th. That Ibe Secretary of Agriculture Is hereby authorised and directed to make examinations and surveys for. and. to locate and construct, as herefn provided. In any state or territory. Including lands within ceded Indian reservp- tlonr, and public lands of any 'kind, drains, canals, levees, dikes, revet ments, fiedgates, pumping plants’, reservoirs and other necessary work for the control of floods or for |he protection, drainage, -er reclamation of wet, overflowed or swamp lands, all of which are dangerous to the public .health o fthe cltisens of the various states, butrwhich can be re claimed and made available for ag ricultural purposes, and to report to ('ongress on or before July Unit of <tcb year the result.sof such exam inations and surveys, giving esti mates of cost of all contemplated works. |he uuantlty and location of the lands which can be protected, drained, or reclaimed Ihereby. and all facts relative to the practicabil ity of each project; also the cost of works in process of construction as well as those which have been com pleted; and. in order that sa„id re port may be In print for the Infor mation of Congress at the begin ning of each regular session there of. the Secretary of Agriculture, as soon as said report is complete^, is hereby authorized to transmit the same to the public printer with the statement that the usual humber of copies is required, and that the pub lic printer is hereby directed to print the same. Injury to, or destruction of any survey monuments? or of any works constructed or in the course of construction under the authority of this act, or "of any plant or ma terial thereof, shall be deemed a felony; and any -person convicted thereof shall be punished by a fine of not exfeeding $5.«0ft, or Impris onment not exceeding five years, or by both such fine and imprisonment at the dllcretlon of the court. Hec. 8. That wherever a develop ment of power Is necessary for the protection, drainage or reclamation of lands under an> t>ro;ect under taken under this art, dr an oppor tunity Is afforded for the develop nrent of power under any such pro ject. the Secretary of Agriculture is authorized to lease for a period not exceeding fifty years, giving prefer ence 'to municipal purposes, an/ surplus power or power privilege, and the money derived, from such lease shall be covered Into the drainage fund and be placed to the credit of the project from which such power Is derived. Sec. 8. For carrying out the pur poses of this Act there Is hereby au thorized. from any funds in the treasury’ not otherwise anproprlat- ed, the sum of lio.ooa.ano, which shall be expended under the direc tion of the Secretary of Agriculture, and which shall be available .until expended, and this sum shall be ad ded lo from time to time^as may be necessary.
