The Supreme Court of the State has
lately filed a very important decision
relative to ths validity of contracts
made by mat rted women. The facts
in the case were : Ruwi*& Wilhulf, be
ing Indebted to C. C, Habeuieht, gave
him a note, with Mis. Jennie Aguew,
a mauled woman, as surety. The note
being sued on, the Court holds that
Mis Aycew’s contract ns surety is void.
The Act of 1872 gave to a mauled wo
man the right ’to contract or be con
tracted with in the same mantn r as if
she were unmarried." Bui the Revis
ed Statutes of 1882 amend the Act of
1872 by inserting the words ‘as to her
separate property.’ The Supreme
Court holds that before a married wo
man cau be made liunle on a contract
made.hy her, it must be made to ap
pear that tbe contract was made in re
lation to or concerned her separate pro
perty. The Court goes- further ami
says (we quote from the decision): ‘If,
therefore, a wife almuld sign a note as
security for her husband, or, Indeed,
for any other person, <aud should de
clare in the note in express terms her
intention to Land her separate estate,
that would not make the contract val
id at lo her, unless It was made to rip
pear that the coilfuet, tbojigh execut
ed by her as surety, was designed to
benefit Iter separate property, or In
some other way related to or concern
ed soch property.’
