Whereas, It la apparent that an ef
fort la being made by tbe eiiculation
of petitions for signatures throughout
the county to repeal tbe law known as
tbe prohibitory law of Barnwell county,
And wheieas, tbe reasons set forth
la said petition are based upon tbe ac
tion of tbe Grand Jury In their pro-
eentmeot at tbe last term of the Court,
and other allegations without regard
to facta or fldeuty.
Aud whereas. It behooves every good
and law abiding citlxon of the county
to raiss hla Voice agaiust the repeal of
tbe law upon such groundless allega
tions and sentiments as set forth In
the petition or the recommendations
of tbe Grand July, wklcb body did uot
represent tbe seutimeot of tbe mujorl

maintain.
Be It resolved, Thet we, the people
•f Barnwell county, delegated from the
different sections of tbe said county,
and now sluing in con vent Ion, do most
heartily endorse tbe law known as ibe
prohibition law of Barnwell. That we
condemn In the strongest terms tbe
aMlon of tbe Grand Jury in assuming
to themselves the right to speak for
the people at large and to make re
commendations for ths passage or re-
l<aal of laws, and can oply attribute
the cause of such action to Influences
which did not represent the true senti
ment of the paopta.
That this body now proceed to elect
or appoint a committee of Are whose
duty It shall be to vlalt the capital of
the State where the LegUlatuie is now
sitting In Gsneral Assembly, and pre
sent through the Boa. Senator aud
Representatives of this county to that
honorable body each petition or me-

day in the State Supreme Conrt that ere
regarded by the (cgal profession as of
ununonl interest :
Io King rtt. Fraser, a Charleston esse,
the Court holds that a mortgage not re>
corded within the time prescribed by law

under tbe Act of 187G, ani is preferred
to innocent unsecured creditors for vah
uable consideration, without notice,
whose debts were created between the
date of tbe mortgage and the date of its
record.
In Walters vs. Kraft, a Columbia case,
upon a joint and several promissory note
paysb'e July 1, 1872, upon which was
paid by the principal debtor the interest
every year until 1878, action wss iusti
luted against all tbe makers February
21, 1880.. The Court hohis that the ao-
ttun is barred agninst the parties not
making the payment *f interest by tbe
Statute of Limitations.
In Gardner vs. Gardner, also* Colntn
bis ease, the decision is that the receipt
of interest in advance on a past doe note
is conclusive evidence of a valid contract
to give Author time, unless the creditor
shows that it was a mistake, or that there
was a special agreement at the time that
his immediate right of action on the note
•hould *ot be suspended, and there be
mg no auch showing iu this case, that
there was an extension of credit and the
surety thereby discharged.
