From the Ch irleston Sunday News wc take the following full account: The proceedings in tho cose were opened at half-paat 9 o’clock and the prisoner put upou trial. William Freeman, tho accused, appeared to much advantage In the dock. He was elaboiately and carefully dreesed io a black broadcloth suit, and was much lionized by a numerous contingent of frleods from bis section of the coun ty. He displayed a drooping and Itetlees expression and paid but little heed to what whs going on around him. Ail of bis children were In Court and the only exhibition be gave of any Interest whatever was an occasional glance towards the group of ft lends with whom his chll dreo sod wife were seated. Col. Rob ert Aldrich appeared in his defence, and Acting BolicUor Iz sr for the pros ecution. THE STATE 8 CARE. (T The case for tho State was opened with the evidence of Dr. W. H. Hay, who testified that he woe called upon to make the post-morrem examination of the body cf John Clayton; who had been killed on the nlgnt! of the 29 h of December last at AHendale. On that examination be found that death had almost instantaneously reunited from a pistol ball which passe:) through ths.left arm and entered the heart of the deceased. He saw the body on the night of the 29 h lying Just where Clayton had been killed, a few Stefas outsldo of the fence dividing Clayton’s from Freemnu's yard— When he arrived at the scene of the tragedy on that night life was extinct and the post mortem examination was held on the following day, Edmund Brown, colored, testified that on the night In question he w. nt to- the depot at Allendale to meet Mr. Clayton, who arrived that night from flavhonali. He took Mr. Clayton’s valise home and rein rued to find Mr. Claytonj for whom be had a mes sage from Mrs. Clayton. The witness fooufi Mr. Clayton to Moore’s billiard aaloon, where William Freeman and a man name Paul Williams were playing billiards. Freeman was playing when the witness entered, and only scored one point on the shot. Clayton was looking on at the game and said: — “Now, you hare played hell; you have only mode ooe button.'’ Freeman said, "That’s none of year d—d. business;" and then Clayton said: “ W6II, then, I am out of It.” After some further dis pute both parties went out iu the street where they again commenced quar relling. and after some wry Indecent and profane language the parties sepa rated, and Freeman in going eaPU— “God d—n you t yoii are a better man on muscle than 1 am ; but I.’ll see you affaln.” Clayton started off to follow Fret-man, but on the advice of the wit ness 'he went home. While Clayton was at home eating supper and the witness was sitting down i t the house. Freeman came up on the rear of the building and ealled for Clayrou. Mis Clayton tffcnt to the back door and Invited Freeman Into the house. H»* refused to come In and treked Clayton to come out; that ho wanted to apolo gise to him for *hat occurred In the evening. Ciujton went out and the witness went out alno when he beard the noise that was going on. He beard Freeman, say ; “John, I don’t want to take any advantage of you, aud I can hurt you badly, a/id that d—d quick.” Mrs, Clayton then aatrt, “ Cousin Billy (Freeman) don’t you shoot, Mr. Clayton held up hts arms and said, **God d—o you* you »e* I haven’t anything but my natural fist, but if you want to light I’ll fight ou with anything , even a brickbat.” reeman then pulled out his pistol and fired at Clayton twice. When Freeman came to the fence he said ’he came to have revenge, and Mr. Clayton asked btno twice what was he mad about. Mr. Onyton then pulled r off his coat, and Just pr soon a* his coat fell from hia hands Freepian shot him t vice.' , ~ This testimony closed thA evidence in chief for the State. THK DETKNCE. The defense then put up Mrs. F. J.- Freeman, the wife of the prisoner Hhe said that on the 231 of December John Clayton came to her houae while ber husband wasn’t, homo. He came to borrow her satchel, as be waa going to Savannah next morning. Witness went and got him the satchel, which he took and put it down iu the corner of the room. He then came over to the witness and ‘took bold of her atm and made an Indecent proposal’ to her. The witness continued : ‘I told him to leave tny house at cnce and never to come btick again : and that I inten ded to tell my husband about bis talk. My husband didn’t come home that night, and *ben be did c<-me I didn’t tell hlto, because Clayton was gone Whe,o Clayton eame back from Savau uah on the ‘29th I then told my bus- band and asked him to go over to Clay ton’s bouse and tell him that he knew all about It. My husband went over and after a while I heard some loud talking and I went out on tbs back porch and I heard tny husband sayinff ‘stand back, stand back,’ and I beard Mrs. Clavton say ‘Clayton don’t shoot Ootistn Hilly.’ I then h'-ard Clayton say with an oath, ‘I’ll kill him,’ and then I heard two shota and my has- baud cams back to the house.’ The witness then went oVet to the scene <d the killing ami came back tn her bus ban-d and told him that Clayton was dead. She said that Miss Boyle, a young lady who woe staying with her, was going on a visit next day and that she would he alone ‘in the house. 8hs uskod me to go over and see Clayton about the m it ter. I walked over to Clayton’s house by a near cut to where flnihe boards were knocked off the fence. I called him ami Mrs. Clayton c-me to the hack door ami asked me to come In. I told her I didn’t have time, that I only wanted to see Cfayton—I think 1 said Johnny. He came out su 1 she went hack in the house. As soon as I mentioned this to him he began to curse nnd swear he’d maul h —II out of me and all that kind of thing. 1 sal I, ‘Johnny, tills thing can't be act tied wlthrmt pistols,’ and he came to wards me and then Mrs Clayton came out. I Raid ‘stand back,’ aud he Came up as If he was going to take hold of me. I said again, ‘stand back, don’t you come any nearer.' He kept ad vanclttg and I kept going bank for about 12 or 15 or 18 steps. Mrs. ( layton then Raid, ’Clayton, why don't you come back and let your cousin Billy alone.’ She said something before that but I don’t remember what It was. When I fired the second time h« drop ped to bis knfees and s&id, T «m hit.’ I thftn Went back to my house.’ That was the statement of the pri soner, and io fact the whole case for the defence. Miss Ida Boyle, the ntxt witness for the prisoner, corroborated the prlsoner’astMtemefit in relation to Freeman’s telling Clayton to htand back and as to Mrs. Clayton’s saying, “Clayton; don'tyou shoot Cousin Billy, according to the defendant’s tesllmo- n y. . ■ The defence then put up two wit nesses to prove the noreUabliity of the colored witness for the State, Edmund Brown. THE REPLY. In reply the Htate proved that Clay ton. had oo pistol on the night of the killing, a fact, however, which the de fendant Would not swear to on bia cross-examination.
