AN ORDINANCE

C.y for th# year from May 1, 1M6,
to -May 1. 1M6.
B« it ordained by the Mayor and
Conncilmen of the City of Camden, in
Connell assembled and by the author
ity of the same. '
Section 1. Every person, firm, com
pany or corporation, engaged on May
1, 1944, In any calling, business, pro-
fOBSion or occupation in whole or in
part within the City of Camden, as
may be hereinafter specified, shall ob
tain during the month of May, 1946,
a license therefor In the manner here
inafter prescribed. Every person, firm,
company or corporation commencing
business in said city on or before the
first day pf May, 1946, shall in like
manner obtain a license therefor be
fore entering upon such calling, busi
ness, profession, or occupation as
hereinafter specified.
Section 2. Elvery person, firm, com
pany or corporation engaged in or in
tending to engage in any calling, busi
ness, profession or occupation for
which a license is required, shall ap
ply to the Clerk and Treasurer of the
City of Camden for. the same—by
whom all such licenses shall be is
sued, and shall at the time of apply
ing, make and sign a written state
ment under oath, and file it with the
said Clerk and Treasurer, setting
forth: First, his or her or its name
or style, the name of the persons con
stituting such firm or company. Sec
ond, the calling, business, profession
or occupation for which license is
required, l^lrd, the place where such
calling, business, profession or occu
pation la to be carried on: the amount
of capital Invested or the gross an
nual income. Parties in business on
the first of May, shall make such ap
plication for new license and file such
written statement before May 21et.
Section S. A penalty of fifteen per
cent shall be added to all licenses
which are not paid during the month

however, that immediate payment may
be required in each and every case
at the discretion of the said Clerk and
Treasurer, and the foregoing provis
ion shall in no wise stay or hinder
action to enforce immedfate payment;
which tax and penalty shall be recov-
«‘ed in the manner hereinafter pre
scribed, and if any person, firm, com
pany or corporation required So to
do by the terms of this ordinance
shall refuse or neglect to make out
and deliver tor the Clerk and Treasur-*
er of the City of Camden, on or be
fore the time ^herein required, the
statement provided for by Section 2
of this ordinance, or shall make a
false statement or shall refuse to
take and subscribe an oath or affirm
ation as to the truth of such state
ment, or any part thereof; or from
any cause shall fail to take out such
license as may be required by this
ordinance, t^ said Clerk and
tirer shall report the case to' the
Mayor, who shall proceed to ascertain
as nearly as possible, the business of
such person, firm, company or corpor
ation, for which he, she or it may be
liable to a license tax therefor, and in
case of default for the purpose of
such investigaiion, the said Clerk and
Treasurer shall notify the pe^Bon^
• firms, companies, or corporation in
default to appear before the Mayor
at his office—at a time stated.in said
notice; and also such witnesses as the
Mayor may desire to examine. The
witnesses calle<l as aforesaid shall be
, examined by the Mayor, under oath
‘or nfffrinatloii. touching the nature of
the huslntss of such party, and every
thing which may evince the amount
of license tax for which such party
shall be liable.
From tho information thus acquir
ed the Mayor shaH find and assess the
amount of license tax dne by sUch
party whether he. she or It attended
tho investigation or not, and shall
add thereto a penalty of fifteen per
cent thereof, and should such license
tax and penalty be not paid wllhln
five days thereafter, the said Clerk
and Treasurer shall tosne an execu
tion therefor under her hand, and the
seal of the City of Camden, directed
i to the chief of police of the City of
(Camden, or the Sheriff of Kershaw
* County, in said State and the said
chief of police or sheriff shall ..pro
ceed to collect the said Ilcenae tax
and li^Ry, by levy and sale of real
or personal property, Aa now provided
by law for the collection of taxes, to
gether with an additional five per
cent of the whole amount, which shall
be the sheriffs or chief of police’s
compenkktion for making' such collec
tion, In addition to one dollar for
making such levy, which shall be paid
by delinquent without entry or mile
age fees; provided, however, that any
person or corporation shall have the
right of appeal to the City Council
of Camden (notice of such appeal hav
ing been given to the Clerk and Treas
urer within five days from the time
of which such assessment of license
and penalty shall have been made)
and upon hearing such appeal, the
said Council shall make such order
therein as it shall deem Just and
proper; and provided further, that in
lieu of the remedy above set fo’rth
to enforce payment an action or ac
tions may be brought in any court of
competent Jurisdiction for the recov
ery of such Ileenss tax and penalties.
And provided further, that any per
son, firm, company or corporation who
shall egyry on, or attempt to carry
on any calling, business, profession
or occupation without a license as
herein required, or who shall neglect
or refuse to give the information re
quired or to answer such question as
may be required or who shall fall to
attend before the Mayor to be exam
ined by him when so required, as'pro
vided in Section 2 and 8 of this ordi
nance may be deemed guilty of a vio
lation there^ before the Municipal
Court and mi^ be fined not more than
One Hundred Dollars, or to be impris
oned not exceeding thirty days.
Section 4. All licenses granted un
der this ordinance shall be i>osted in
a eonspicioxia place,, except In case
of vehicle* for hire, which vehicle*
shall have placed upon them metal
badges with the number of badges
and the license year marked thereon,
such badges to be furnished by the
Clerk and Treasurer upon payment
of the license tax. Failure to dis
play auch badges will subject the
persons owning or using the same to
a penalty of not more than Five Dol
lars or imprisonment not exceeding
ten days. The license granted under
this ordinance shall at all times be
subject to Inspection by any officers
of tbe City of Camden and no calling,
business, profession or occupstlon
shall be carried on elsewhere than
the place named In this license there
