dairyman had. as a "wholesaler," sold
milk at Shaw Field* in excess of these
pricee, that be had sold to retail cna-
tomers also in excess of retail prices
and has failed to keep an accurate
record in accordance with OPA regu
lations.
In reply ,to the question as to
whether or .not Onion was a whole
saler, Judge, Timmerman retorted
"Congreu has declared a policy -not
to pnnlah people for any inadverdent
Tiolations. only for wilfid ones." Tim
merman pointed out farther that In
his opinion the word "wholesale" must
be Interpreted according to the Isngn
age of ,the man in tbe street and not
according to rules and regulations
which one may or may not nnder-
stand.
In regard to charges that Onion
had sold milk to the quartermaster
and post exchange at Shaw Field in
excess of ceiling prices. Judge Tim
merman atated "the tectimonr does
not support such a charge." and that
"price regulations are not being inter
fered with."
Stating that they had been erron-
eoosly advised as to transportation
rates on milk, OPA officials remarked
"it was never our intention to pen
alise anyone on inadequate informa
tion.”
C. E. Logwood, director of the
freight and express bureau of ths
state pnblic service commission,
pointed out that no common carrier
freight rates for the transportation
of milk in glass quart bottles in inter
city truck servlM was, to his knowl
edge, in effect

to concur to specific rates in trans
porting milk.
