Ky., March 21.?Harlan county's "travesty of justice," in which a woman is alleged to have, by perjured testimony, conceived in jealousy, aent a man to |>r #*>?? under life sentence, came back before a grand jury today. A petition for a pardon for Conley Dabney, 26 years old, under life sentence for the "murder" of Mar> Vickery, 16, was being circulates! today. Judge J. t*. Forester ordered the grand jury to "sift the case to the bottom," A frightful travesty has recently been committed in Harlan county," Judge Forester said. "It is of such u nature as to horrify even the most callouses!. A man w?? indicted in this court for on u charge of brutal murder ami assault on a 16-year-old girl. This man is serving time in the penitentiary under a life sentence for the murder of a girl who is alive and at the present moment is here in Harlan. I he jury decided the case upon the evidence of witnesses. One of these witnesses detailed the murder of that girl as an eye witness. A mote dastardly deed is inconceivable." Miss Vickery, who came hack Saturday with a story of having left home because she was dissatisfied, and Marie Jackson, 27, the state's principal witness at Dabney's trial, were among those expected to be called before the grand jury. Both are being held pending an investigation. Dabney, in a statement made at the reformatory the day Miss Vickery showed uj), said the Jackson woman testified against him because he would not leave his wife and two children and go with her. Miss Jackson stubbornly clirlgs to her story?that she saw Dabney kill a girl known to her as Vickery. County officials today sought to identify the body found in an abandoned mine after the Vickery girl had disappeared. Charles Vickery more than a year ago identified a coat and ring on the body as articles resembling those belonging to his daughter. Positive identification of the body itself was impossible, Sheriff George S. Ward said today. Sheriff Ward said county officials were considering the possibility that the body was that of Mrs. .Jim H. Cole, who disappeared some months before Mary Vickery left. Mrs. Cole has not been seen here since then. The sheriff said he was inclined to doubt whether any of the principals in the Dabney case were implicated in the disappearance of Mrs. Cole. Dabney was the only witness for the defense at his trial. He denied all of the charges, contending that he did not know the Vickery girl, and that if he, a taxicab driver, had hauled her to a railroad station, he was unaware of her identity. Noted Florida Physician Dies Key West, Flu, March ID.?In compliance with his expressed wish Dr. Joseph Yates Porter, organizer ot Florida's health system in 1888, and eminent authority on yellow fever, who died here early today, was burled this afternoon. He had been ill for some time. Dr. Porter had directed arrangements for the services even to the list of pallbearers. He died in the same room in wri n he was horn nearly eighty years ago.
