rather brief charge hy Judge Mem

Testimony was all in thin morning
?at 1 I o'clock after the defense had
introduced five additional witnesses,
making a total of twenty-four in. all.
Four of these this morning testified
to the coolness* and courage of Mc
Fadden. Two of rthese .served with
him in Company < 1 , 118th infantry,
in France.
Judge Memnvngcr re fused to al
low testimony as to how McFadden
acted under file a: liellico'urt and
.other fields in France and Belgium,
Among those who had been called
to give such testimony was Col.
Arthur Spratt, former lieutenant
colonel, former commander of the
1 ISth infantry of the Thirtieth
It was ('apt. Carlisle White, pi h
tol expert, who gave ordeal testi
mony as to the course of a bullet
fiied at. a fleeing automobile by a
speeding motorcycle. McFadden claim
ed on the stand yetfterday that the
'third and last from his pistol had
been fired unintentionally while he
was trying to eontrol his machine,
and he said he had no idea where it
went. The defense claimed it was
tli is bullet that took tjie other man's
life. The state claims it was ? the
second shot fired, and McFadden said
he fired at a rear tire deliberately.
Five and otic-half hours today were
consumed in argument of counsel.
Senator David Hamilton of Chester,
John K. Hart of York and \V. B.
Wilson of Koek Hill, counsel for the
defendant, argued that their client
had. acted only in 'the discharge of
his duty, that In- was trying, to stop
n car flying at sixty miles an hour
which endangered the lives of citizens
