many young couples who desire to
be married do not understand thai
they cannot be married dii an affi
davit to obtain a marriage* license
and ' because many persyns vented
with the authority of a notary pub
lic, who are authorized to perform
the Marriage rites, do not under
stand that they cannot use the af
fidavit but must secure the license
before officiating at the ceremony,
confusion result* and the marriage
must bo performed the second time,
Probate Judge K. Hurton Hicks, an
nounced yesterday.
Judge Hicks says that several
^?ases of that nature have come bp
fore him r^-ently and that he de
sired to acquaint all persons contem
plating marriage who are authorized
to conduct a marriage ceremony wjth
the provisions of the law.
Confusion results when a couple
who have given in their names in the
probate judge's office, take the affi
davit (ov the license to the tVertsur
er's office to pay the fee and fail
to return to his office for the license,
which fa detached from the affidavit
and held until it has been paid for,
he said.

of South Carolina, volume .'1 page
1038, regarding the marriage proced-,
ure, as pointed out by John Hicks,
is given as follows:
''License Required for Matrimony. It
shall be unlawful for any person to
contract matrimony within this state
without first procuring a license as
is hereinafter provided; and it shall
likewise be unlawful for any one,

out ".said persons first delivering to
the party, performing said marriage
ceremony a license as is hereinafter
provided duly authorizing said per

fine of not more than one hundred
