Simms "guilty of being under the influence of intoxicants while on the bench and out of court," came this evening when !i jury in city recorder's court found Attorney Kurtz 1'. Smith guilty, under rtty tirthniinof^~nf operating an auto mobile while under. the influence of li quor, the charge growing out of the ride participated in by Mr. Smith, Judge Simms and Court Stenographer* l.'iydc V. Smith. The trial probably the most hotly i iitttestu<h in the history of t he record er's court, lasted for more than five and a half hours without intermission, the jury's verdict being rendered after !e>s than ten minutes deliberation.
