The s?<cond case called named as de- j
feiiilants Frank Moore, Fd Hicks, J. K.
Knox, I'aul Hall and Fd < 'oleman, all
negroes, charged jointly with the murder
of (Million Lee. In this case the prose- j
cut ion attempted to prove the live ne
groes were leaders of the Flaiuc "squad".
Witnesses for the State repeatedly tes
tified that Moore, Knox and Hicks acted
as leaders, giving orders the morning
of October 1 when the negroes gathered
near Moore's house, and forming in r
column of twos, marched toward Hoop
Spur, where they had heard shots. John
Jefferson, negro, testified Hick was pres
ident of the Klnine post of the union
and Knox, vice president. He also said
that *Knox, who brought up the roar
of the Column, said he would shoot any
deserters. Witnesses also testified to
the presence of Hall and Coleman in the
squad that morning.
? Dave Archer, a negro who said ? he
did not belong to the union, tet*tified
the members attempted to capture non
m embers the morning of the disturb
ance, arm them and <tmtpel them to join
their ranks. He said he had been rap
tured and armed but had escaped.
During the testimony the name of
Itobert I.. Hill, negro, alleged organ
ize i* of the union, frequently was men
tioned. According to the testimony of
<*reen in Frank Hick's trial. Hill told
the members of the union at a meet
ing tlie Thursday before the disturbance
that they "might have trouble and to
stand their ground."
Arguments for a verdict of second
degree murder were presented to the
jury by (Jreentield Quarles, of Helena,
appointed by the court as counsel to
defend the tire negroes charged jointly
with the- murder of Lee. John K. Mil- 1
ler. provrviftiug attorney, closed for the
State, and seven minutes before the
ca^o was giveu to the jury, a verdict
of guilty of first degree murder Vvas re
turned against Moore, Kd Hicks, Knox,
!1k!I and <V>lemau.
A serious accident occurred near Ilen
nettsville Wednesday mornina: when a
westbound freight train struck the au
tomobile driven by Jeter Manahip, In
the rar were Mrs. Manship, her mother
and sister, VLro. Copeland, and three
children. All of the occupant* were
