j/Wl Findings Of The County!
Hoar.) Of Canv 'assers;
to announcement last!
i v\?.*? k the c?ijnty Hoard <? f Canvass |
j <m k met at the C'ourl House Inst I
Monday to consider protests liled!
with the Hoard. The nature of!
the*..* protista have been published.
1 lu< fallowing two i lie findings of
ihe Hoard of Cunvusseia *.
State of Smith (Carolina, County of
Kershaw. In r? 1'rnleat tiled
H^hiuht Special Klectlons in Ker
kIihw county, held June 20, 11KI7,
<>n question of Snle and Manu
facture nf Intoxicating Liquors
Heard by County Hoard of Can
vnbsers for Kershaw.
KIN 1)1 N OS () V CO 11 NT Y HO A li D
OK CAN VASSKRS.
The Hoard finds in respect to the
various protests filed in the ubove
entitled matter.
1st. That this Hoard cannot re
view the finding of the Supervisor
that the petitions of said elections
were sulllcient in form and sub
stance, mid that if the Hoard can
so enquire, such petitions were suf
ficient and not invalid because
said petitions united questions of
sale and manufacture.
2nd. That the Dispensary Hoard
has no legal authority or ofllcial
power to enter and maintain this
protest, fti)(i the members thereof,
if they hud protested as individuals,
are estopped by voting and waiv
ing objection to the arrangement
and labels of boxes. Mr. Rabon re
pudiates the protect, and W. .1
Dunn by voting on Clerk's certifi
cate of Registration connot ques
tion the legality of same.
3rd. That Mr. Schroder ?#d
Mr. Schrock are precluded or es
topped by their conduct at Camden
polls from protesting against any
similar alleged conduct of bystand
ers, but the conduct of those sur
rounding the polls is found not to
havo been unbecoming or unusual
is cases of Interested partic.pants
aDd observers in free and open elec
tion, and the only ill conduct prov
en there was on the pari of said
Schroeder, Schrock and one Sal
mond. That said Schroeder,
Schrock, MeSmyrl and other pro
testants, ail of whom (except dis
pensary Hoard) voted in said elec
tions freely and voluntarily, by ho
voting, especially without entering
any complaint to managers are es
topped from now attacking the ar
rangement of double boxos and la
bels, for the several questions, as
unconstitutional, for exposure of
vote and nullifying the election, as
by adopting aud using biiiq? there
was a waiver.
4th. That tlio Commissioners of
Election made anxious eiForts to
secure a perfectly regular and legal
election on all the questions, and
according.to their honost construc
tion of the statute (which the Can
vassers consider it warranted and
would naturally bear to the ordina
ry reader although confused in
phraseology) provided two boxes
for each question ^of sale, profits,
and manufacture, at each polling
place, aud had printed thereon For
and Against each question Respect
ively. That it was competent for the
Legislature to have so provided,
ami that the testimony shows that
such arrangement, while it may
have resulted in allowing the votes
therein to have become known to
watchers, did not deter any voters
from voting, by reason of exposure,
and there is no allegation or evi
dence that any effect wag produc
ts! thereby upon the result. There
was no complaint as to such ar
rangement on the part of any of
the voters. '
5th. That one sot of managers
did act at said elections and could
legally have done so, and no pre
judice resulted from such arraog
ment. \
Gill. That printed instructions
sucli as hjFered in evidence, were
sent to thov ^managers of various
polls, of which, sixteen, no polls
were opened at Hanging Rock.
7th.. Tiiat uvot^r registered pri
or to i8!>8, could legally vote at
his preCioct, upon Clfcrkr's eertillcate
of registration, if his name appear
ed on the precinct hooks. That if
Biich votes should bo regarded as
illegal, the proofs show that de
ducting from the total of votes
cast for and agaiust the respective
questions, the number of such votes
shown to have been ca*t pro and
oon,.and deducting from the total
votes cast against the several ques
tions, those voles in regard to
which it was not shown bow they
were cast, the result is not thereby
affected and a clear majority still
remains as shown by followiag tab
ulated arrangement. It appealed
"that two illegal votes (because cast
bjt voters nol appearing on precinct
books) were oast at Ribon's Cross
Roads, one for spd one against sale,
which counter'bslsnos.
