cutions. The old luw provided that
for each execution issued there
should be a fee of fifty cents. The
last legislature changed it h<? that
the fee was made one dollar, ex
cept in (J hesterfluld county where
it wua made llfty cents for each ex
ecution whether it was collected or
not. In other counties it was only
paid when collected. It is held that
this is clearly unconstitutional ns
it is special legislation.
An opinion as to theso foea and
the salaries of auditors was given
today to tlio comptroller by the as
?i?tnnt attorney general, as follows:

whether the county treasurer in
authorized to charge the fee of one
dollar for each tax execution issued
against delinquents authorized by
section 18 of this act upon execu
tions now issued for the fiscal year,
1904, I beg to say that they are.
This fee of one dollar for each tax
execution |? chargabls only against
the tax delinquent, except in Ches
terfield county, where the feo is
fifty cents, but ischargable against
tho county if not collected out of
the delinquent tax payer.
