JUDGE SMITH
In the death of Judge Mendel L.
Smith Camden, Kershaw County and
the state of South Carolina have lost
an able and brilliant lawyer, a dis
tinguished statesman, a gifted speak
er, an untiring public servant, a de?
vout chiirclun&n and a good citizen.
Judge Smith's ability as a lawyer
and orator was recognized not only
in South Carolina but throughout
the South and elsewhere. HI3 genial
manner and pleasing personality
drew multitudes to him.
Big of stature and bigger still of
heart Mendel L. Smith will not soon
be forgotten!
Clinton T. Graydon, Columbia at
torney, eulogized his colleague brief
ly in arguing a case before the state
aujpreme court:
"He was a great lawyer, a great
judge, and a lovable personality for
whom I had the highest affection ami
regard. His fine qualities shone so
brilliantly that I was not aware, ever
in his presence, of aught save these
qualities and as he lies dead I deem
it a privilege to call the court's at
tention to the passing of this man
from the rapidly changing picture of
life."

MENDEL L. SMITH
Richly endowed, physically men
tally; ardent in temperament, ami
able of disposition, and with an au
thenic vocation to public service, the
late Mendel L. Smith of Camden
served South Carolina variously and
well in a number of official posts.
One who saw him but a few days ago
thought him at the to(p. of his prime
and mo?t likely to go on to other pub
lic service. A natural orator, he had
so developed his talent as to be one
of the most engaging and persuasive
speakers of his generation in South
Carolina ? where oratory is not as yet
the lost art it has in other quarters
become. His unfailing urbanity, per
haps a better phrase would be hia
native graciousne3s and courtesy, is
gratefully remembered by thoso who
watched him in action as speaker of
the house or as a circuit judge. His
death at 68 is a real loss to the com
monwealth he so warmly loved.? -Ed

"DISARMAMENT BY SUBTER
FUGE"
Recently a bill making the possess
ion of email artms a crime was intro
duced in Congress. It was badly de
feated.
Now another bill has appeared. Its
object, as the American Rifleman ex
presses it, is "disarmament by sub
terfuge." Under it an individual de
siring to purchase a p istol or revolv
er would have to obtain from the In
ternal Revenue Bureau, a (permit
form to which his fingerprints and
photograph would have to be attach
ed. Rules for administering the law
would be tmlade by the Commissioner
of Internal Revenue ? and there
would be no appeal whatsoever from
his regulations. He could restrict the
sale of small arms to whatever ex
tent he deemed desirable. In brief,
public policy in this important mat
ter would be entirely dependent up
on the views and whims of a single
official.
This is sftmply one more example
of the ancient effort to disarm the
law-abiding public, on the grounds
that crime would thus be lessened.
Experience has shown precisely the
opposite ? responsible officials in
New York have stated time and s
gain that its rigorous Sullivan law
has been an utter failure, and has
helped, rather than hindered, the
criminal. Simlar laws alsewhere
have had the Mm* result.
What is needed is legislation that
will severely punish possession ?f a
gun by a person with ac riminal re
cord, and that will lincreaae the pen
alty for crimes committed with the
aid of firearms. At this time a mul
titutde of publications and organisa
tions and individuals are seeking to
prevent the passage of this new Con
greoslonal bill ? knowing that to dls
