MEANING AND IMPORTANCE
OF STATES’ RIGHTS
The most important single do
mestic issue which will confront
the American people when the Oon-
1 gress reconvenes in January is the
issue of States' Rights—the problem
of preserving the rights of the <ev
Jeral states against ever-increasing
national encroachment It is certain
that a strong, punitive so-called
‘civil rights" measure will be push
ed by the radical forces early in ‘he
session, and in very large measure
the future of States' R.^h’s in Amer
ica will hinge on the outcome of the
struggles which will develop over
this bill -
It is essential that the peof •• of

portarice of States' Rights. And in..
'order to do that, we must, of course
, be very clear m our minds as to
just what we mean by the term
There are some who would lave
us believe that States' Rights .s no
more than a time-worn Uliche which
is employes! by Southerners as a de
vice to facilitate the exploitation of
racial minorities We know that *his
is not '<> States’ Rights is an endur
ing and valid principle which com
pletely transcends the issue ot -ace

inalienable human right for which
over the centuries, our ancesfers—
both in Europe and in Aemerica—
have fought, struggled, and died In
the establishment of our Union, we
recognized this right of self-govern
naent, we incorporated it in our
.written Constitution, an we gave :t
its American n a m e of States’
Rights.
Important as this principle of -elf
rule is, however, States’ Rights is
i more than that In our American
i constitution system. States Rights
is tile keystone of Individual Lib
erty States’ Rights is one of the
.two main principles which ’he
Founding Fathers built into the Con
stitution to insure that Americans
would be forever free.
The other principle relied upon
| by the Founders was, of course,
the principle of Separation of Pow
! ers—die independence of the three'
, coordinate branches of the National
i government. These two devices—the
Nation-State division of powers, anti
| the separation of the judicial, iegis-
i lative and executive functions—con-
istitute the basic framework of our
I system of checks and balances
The ultimate objective of this
checks and-balanccs system, indeed
the highest purpose of government,
is the protection of the rights and
| freedom of the individual citizen—
! the promotion and preservation of
individual liberty. ‘'Liberty.” said
| Lord Acton, "is not a means *o a
higher political end It is itself the
highest .political endf’
The Fourniers were determined

American people must be preserv
ed. They knew full well that the
greatest potential threat to the lib-
! try of the individual lay in govern
ment. That is why they were in
sistent that the new government

structure into a compound Federal
Republic .1 round two basic prin
ciples: Separation ot Powers and
Status' Rights.
Thus we can see that States
Rights is no mere meaningless slo
gan, but is a vital feature—an in
dispensable elemen'. in fact—of ’he
structure of our checks-and bal
ances system, which is the very
basis of our indivdmal liberty In
keeping up a constant struggle /or
States’ Rights, we are fighting not
merely for a name but for an essen
tial support of liberty: "the highest
political'’fend.”
