night. The jury came out at 9:55
p. m.
Spoon was charged with assault
and battery with intent to kill in the
June 2 beating of Woodell King, 42,
at the O. K. taxi stand in Clinton.

was tried in the November term of
court and cleared of participation in
the affray.

chief, who answered the call that a
fight was in progress at the taxi
stand; Furman Bagwell, who ob
served the fight from across the
street; Rufus King, brother of
Woodell; Mrs. Mack Stubbs, his
sister; and Mrs. Kate Jones. W. H.
Spoon, father of the defendant, had
been called to the witness stand
when court recessed late Monday
afternoon.
