undetst(MHl that the hearing was in
connection with the motion.s made by
the defemlant to change the place of
trial of the pending case from Lau
rens to (’olumbia, and other prelimi
nary motions.
The litigation, it is stated by at
torneys, grew out of a contract made
by Kbert with the .Masonic Tern pie
CorfKiration of Ginton to purchase
their property on .South Broad stre<*t,
thr* said contract having been made
in .January of this year. It is further
staUnl that the defendant has failed
to carry out the contract.
In .January of this year, IL K.
Klicrt, head of the Dixie-Home .Stores,
a chain of cash grcK-eries operating
throughout the state, contracted to
purchase th<* .Masonic Teinfile prop
erty and the deal w’as scheduled to l>e
clo.s<*d in February past. The purchas
er, it is allegeil, failed to comply with
his contract and suit was started to
fotx’e compliance and al.so to collect
damages for the failure of the pur
chase-r to fulfill the contra<-t.
The jilaintiffs in the action are rep-

this city, and .John \V. Cri-ws of (’o-

maintained in one suit, but did not

.Mr. Wade further stated yesterday
that the plaintiff will probably appeal
to the Supreme Court from the order
of the judg? hea-ing the argument, ijH
