AN ORDINANCE
TO REGULATE LICENSE FOR THE YEAR

Section 1. Be it ordained by the Mayor and
Councilmen of the City of Florence, in Council
assembled, That every person, firm, company or
corporation engaged in any trade, business or
profession hereinafter mentioned within thfe limits
of the City of Florence, shall obtain on or before
the 10th day of July, 1920, a license therefor in
the manner hereinafter provided.
Those commencing business after the 10th of .
June shall obtain a license before entering upon
that business.
Sec. 2. On the business of the following, viz:
Upon each and every merchant, or any other
person or firm,' company or corporation, doing
any kind of business at retail within the limits
of the City*of Florence, and for each store and
place of business within the corporate limits of
this City, except such as are especially taxed by
this Ordinance for which a special license shall be
collected:
On sales or receipts not exceeding $ 1,000 $10-00
On sales or receipts not exceeding $ 2,500 $15.00
On sales or receipts not exceeding $ 5,000 $20.00
On sales or rlfceipts not exceeding $ 7,500 $25.00
On sales or receipts not exceeding $10,000 $30.00
On sales or receipts not ekceeding $13,000 $35.00
On sales or receipts not exceeding $17,000 $40.00
On sales or receipts not exceeding $20,000 $45.00

ceipts or any parts thereof when they exceed

Upon business done at wholesale the sum of

sales or receipts or any part thereof when
they exceed $25,000.00.
Sec. 3. Every person, firm, company or cor
poration required by the Ordinance of the City of
Florence to obtfiin^a license to engage in any
trade, business or profession for which a license
is required shall befpre the 10th of July of each
year, register with the City Clerk, first, his or her
name or style, and in case of a firm or company,
the names of the several persons constituting
such firm or company, and their place of busirft*ss:
second, the trade, business or profession for which
a license is required; third, the place where such
trade, business or profession is carried on, and in
the case of a dealer in goods, wares, or merchan
dise, the full and true amount, extent and value
of business carried on; all of which shall be given
under oath, by the owner or member of fi:m or
officer of the corporation or authorized employee
having exact knowledge of the actual business
done. And in case it shall appear to the City
Clerk that there are errors or inaccuracies in the
statements so submitted under oath as to the
amount, extent or value of the business carried
on, the City Clerk is authorized and required to
summon the owner, manager or other person of
the business so stated to appear before City Coun
cil and answer under oath as to such matters
upon the information received, to add to or reduce
the figures of such statements as first made and
fix the license fee accordingly..
All persons, firms, companies or corporations
commencing business on or after the 10th day of
June, 1920, shall register as aforesaid. It shall
be the duty of the City Clerk to assess all per
sons, firms, companies and corporations liable
for City licenses under the ordinances of this
City, and to enter the same in a book, known as
the License Book, giving a classified and complete
list of all such persons, firms, companies and cor
porations who are liable for City licenses, and
the amount of the license for which they are
liable, which license shall be obtained as herein
provided, on or before the 10th day of July in
each and every year. Licenses shall be issued
by the City Clerk and Treasurer, who shall keep
a record in the License Book of all certificates
issued. It shall be the duty ot the City Clerk, to
enforce the payment of all licenses fixed by the
Ordinances of the City of Florence, and assessed
by him under authority thereof, as aforesaid, in
the manner prescribed by the laws of the State
of South Carolina, and by the Ordinances of the
City of Florence.

Sec. 4. If any person or persons exercise or
carry on any trade, business or'profession for
the exercising, carrying on or doing of which a
license is required by this Ordinance, without first
registering or taking out such a license as in
that behalf required, he, she, or they, besides
being liable to the payment of the license, shall
be subject to a fine not to exceed $40.00, or
imprisonment in the City Station House for a
time not to exceed thirty days upon conviction
before the Recorder or Acting Recorder.
Sec. 5. In every license to be taken out
under or by authority of this Ordinance shall be
contained and set forth the purposes, trade, busi
ness or profession for which such license is
granted, and the name and place cf business of
the person or persons taking out the same, and
the time for which it is granted. The City Clerk
and Treasurer shall prepare a form or license
to be used in each case, and shall have the same
printed and bound in book form, in a neat and
substantial manner, with a proper check or stub
attached to each, upon which shall be written
at the time the license is granted the name of
the party obtaining the same, the length of time
covered by said license, together with the amount
charged therefor; and the party receiving such
license shall keep the same posted in some con
spicuous place where his business, trade or pro
fession is carried on. Any evasion of the pro
visions of this section shall be subject to a
penalty of not more than $40.00.
Sec. 6. The license granted under this Ordi
nance shall not authorize the person or firm,
company or corporafion mentioned therein to exer
cise or carry on the trade, business or profession
specified in such license in any other place than
that mentioned therein. All licenses issued on
and after June 10th, 1920, shall be for not less
than one year, unless otherwise provided herein.
Sec. 7. For a license to carry on any perma
nent or transient trade, business or profession,
the sums herein mentioned shall be paid into the
City Treasury in gold or silver coin, United States
Treasury notes, National Bank notes, gold or
silver certificates.
Sec. 8. Any money lender (private) who shall
charge, accept or receive interest charges or com
pensation' for the lending or use of money, directly
or inidrectly, by whatever name, means or device,
in excess of the legal rate of eight per cent, per
annum, he, she, or they shall be subject to a fine
not exceeding forty ($40.00) dollars or imprison
ment in the City jail for a time not to exceed
thirty (30) days for each offense, and the record
of his, her, or their conviction shall be reported
to the next meeting of City Council, whereupon
the license of such party or parties so convicted
shall be revoked. *
Sec. 9, No person except licensed stables
shall let or hire any wagon, cart, dray or other
carriage or vehicle for transportation of goods
or passengers within the limits of said City with
out first, having obtained a badge from the City
Clerk and Treasurer, paying therefor into the
City Treasury 50 cents, under penalty of $5.00
for each and every day that such vehicle shall be
so run, to be recovered by information before the
Recorder. In case of loss of a badge, the owner
can procure another at the cost of $1.00; Pro
vided, That nothing herein contained shall be con
strued to extend to wagons, carts or other vehicles
going to or from market. For any other business
or profession not otherwise provided for, a license
tax of $5.00 to $100.00; Provided further, That
where two or more branches of business not neces
sarily connected are conducted in one establish
ment or by one person, firm or corporation, a
license shall be charged and collected for each
branch of business so conducted, specified in this
Ordinance, unless herein above otherwise specified.
Sec. 10. Upon each and every dog to be
paid for by the person or persons upon whose
premises the dog is kept, $2.00, and the police
of the City of Florence are hereby authorized and
required to seize and confine every dog running
at large not having on the City badge or collar
for the current year; and for every dog so taken
up by the police, $1.00 additional shall be paid
for the same.
Sec. 11. The proceeds of the license tax shall
be applied by the City Clerk and Treasurer solely
to the payment of the current expenses of the
fiscal year 1920—1921.
Sec. 12. No license shall be issued to extend
beyond the 10th day of June, 1921. The City
Clerk and Treasurer is authorized to transfer
licenses temporarily from one place to another,
or from one person or firm to another, when said
person or firm possesses or purchases same busi
ness for which such license was originally issued;
and whenever a license is transferred it shall be
the duty of the City Clerk and Treasurer to im
mediately make record of the same in the License
Book.
Sec. 13. The City Clerk' shall consult the
chairman of license, where he has any reason to
doubt the occupation of any applicant for license,
or amount to be charged, and the chairman shall
have power to decide the matter.
Sec. 14. The City. Clerk shall be required to
turn over to the Police Department the names
of all delinquent license payers immediately after
July 10th, 1920, and the Police Department shall
immediately bring the delinquents before the
Recorder for violation of this Ordinance.
Sec. 15. Provided, That all licenses herein
required may be taken out for the unexpired part
of the year at the prorata, except when otherwise
herein specified, counting that part of the year
in which the license is issued after June 10th,
1920, and prior to December 10th, 1920, as a full
year, and after December 10th, 1920, as a full
half year.
Sec. 16. Provided, in all cases where a busi
ness was begun after the 10th day of June, 1920,
or there have been no such sales during the year
1920, as to form the basis for showing the gross
receipts for twelve months prior to June 10th,
1920, the license for the gross sales shall be issued
upon the basis that such gross sales will have
equalled twice the value of the greatest amount
of stock on hand at any time during the year, the
amount of said stock to be sworn to by the appli
cant for license, when so required.
Sec. 17. That the City Council shall have
power to revoke any license for just cause.
Sec. 18. It shall be the duty of the Police
Department to investigate and report to the City
Clerk all persons doing business without license.
Sec. 19. That on and after the passage of this
Ordinance the penalty for the non-payment of
licenses to be the sum of 10 per cent for every
month until said license is paid.
Sec. 20. All Ordinances and parts of Ordi
nances conflicting with this Ordinance are hereby
repealed.
Sec. 21. In case of mixed wholesale and retail
business, unless owners or agents can satisfac
torily separate such business, the retail license
shall be charged.
Sec. 22. In case of a new business applying
for a license during any year, when it appears
that said business cannot be placed properly under
the classifications heretofore set out, or it appears
that a manifest injustice be done by so classifying
said business, the Superintendent of the License
Department is authorized to investigate said busi-'
ness and to place such license thereon as seems
just; Provided, That such license so granted shall
be submitted to and authorized by Council before
any business can be done thereunder.
