In Tex as, Mississippi, Oklahoma and Kan sas factories for the manufacture of these plants are now under construc tion. In these States companies have been formed for the manufac ture of the machines after exaustive tests of the plant’s practicability and economy The Quick Ice Making Machine has a field all its own; it solves the ice problem of the small town and rural community hitherto unsupplied with ice making equipment. Two impor tant factors make it practical for this work: First, the low cost of the equipment; plants can be installed complete from $700 up, depending upon size and capaci ty. Second, the short time required to pro duce ice, four to six hours, this means low operation cost; furth er the fact that any kind of motive power may be used, and plant construction so simple that any one can operate it. C. patentee of the Quick Ice Making Machine, is in Columbia and has su pervised the installation of a demon strating machine which will be in op eration here for a week at the Gibbes Machinery Co. A Soutlf Carolina manufacturing and sales company has been organized here with a capi tal of $100,000.00. This company h&s the exclusive manufacturing and selling rights for the Quick Ice Mak ing Machine in the State of South Carolina. The stock in this company has been divided into 10,000.00 shares at par value of $10.00 a share. Part of this stock will be placed on the market immediately to be sold at par. Not more than $1,000 of this stock, however, will be sold to any one individual purchaser. The money derived from the sale o? stock is to be used principally in plac ing orders for the ^manufacture of these small ice plants to supply the demand which will be developed through an intensive sales campaign dur ing the coming Sum mer season. It is pro posed for the present to have the machines manufactured for us on contract. Later it is proposed to build a factory in this city with facilities for making the complete machine here as fast as the demand for them is developed. Cohuiibia, Feb. 25—The- outcome of the suit brought; by the Southern Ex- ipre.-es Company in every county in : South Carolina is recover taxes paid for the year 1918 is awaited with a ! great deal of interest not only in j South Carolina but in other states as Itoell. The company and the attorney general of the sttf e have- aogreed that a test case chall be broug’bi and it has been further agreed that this shall he tried in Richland county, »the ver dict in this standing os the verdict in sfLl of the other cases. The atorneys fer the express company are Barron, McKay, Frierson and Moffa^. In its tom plaint the express com pany sets forth that for many years, prior to Dec. 28, 1917 the company had conducted its business as com mon carrier bq.ween points in this state and points in other states. In the conduct of the business the com pany did not own its syifem of trans portation but carried on its business over the several railroads in. the state. The' company declares that i|.s con trasts with the railroads were in full force and effect on December 26, 1917 when the President of t'he Unit ed St^.es issued his proclamation taking over control of every system of transportatic-n and their appurten ances. The right of the company to conduct its express business was and is tiie right, which was and is assess ed as a franchise by the state and be ing so assessed the valce of the right or franchise was distributed to the several counties of the state on a milage basis throughout the .state. The complaint alleges that the as sessment of the franchise of Mie com pany for the yeatr 1918 in the slate re presented a taxation upon a right of property which did noi exist on the date of the assessment or the date of the collect inon of the taxes or at nny time after Dec. 28, 1917 when control of the railways was taken over by the Federal government. The company claims that since Dec 28, 1917 the railroads operating with in the st ate have been controlled and operated by the yovernment of the pnited States and that ever since that time the express business conducted over the said railroads has been con ducted as a yovernmenf al agency, sub ject to the direction and control o> the Director-General of Railroads. It is claimed by the company ithat as a result of the railroads being tak en over by the government, the rail- way companies were rendered impo- ten to carry out or perform their contracts with the express company and hereupon theh express company ceased to have any taxable franchise in .he State of South Carolina or elsewhere. The company says that subsequent to Deo. 28. 1917 and pending final ar rangement by the government of the United States for the conduct and operaion of the express business over lines of railroads taken over by the government the Southern Express Cmpany continued, by sufffrance and permission of the government, and as an agency of said government, to fur nish express facilities in South Caro lina until July 1. 19188 on which date another companv. the American Rail way Express Comorny, began to con duct hne express business throughout the United States and that after that d:fe the Souhern Express Company ceased ahsoluely to carry cn its traits' portatien business and has not con ducted such business at any time since. One interesting item in the com plaint in the allegation that the ex press' company conducted its transpor tation business In South Carolina and ever its entire territory from the date of the taking over by the govern menl of control of railroads to July, 191S at a loss of more than $76,000.
