C., WEDNESDAY, DECEMBER 20, 1922 LET JUSTICE DICTATE JUDICIAL NOMINATIONS The storm of protest caused by the nomination of Pierce Butler, corporation attorney of St. Paul, to be As hQciate Justice of the United States Supreme Court, as outlined in an intimate article written exclusively for this Newspaper by Edward Percy Howard, a close student of national affairs, clearly shows, the growing evil effect of tarring the judiciary with. the political brush. Unques tionably, unless some way be found to check the reaction ary tendency both in judicial appointments and judicial decisions, the country will seen find itself ready for revolt, not at the hands of labor agitators and economic disturb ers, but at the hands of the plain forward looking Ameri cans who love impartial justice and appreciate fair play. Whatever merit there may be in the attack on Butler may be open to argument, but plainly his legal training with importunate corporate interests is not calculated to have developed in him the judicial mind. The first reform in our judiciary might well come in recognition of the principle of civil service to which this country is committed. No man should be raised to the dignity of the United States Supreme Court until he has demonstrated his breadth of mind and understanding and proved his judicial ability. - Nominations for the Supreme Court should come from the United States Circuit Courts or some other United States Courts, perhaps even from the Supreme Courts of the several states. Such a practice would raise the standard of the lower courts in addition to further safeguarding the rights of the people.. At pre sent the lower courts offer little to atract the ablest of at torneys. The salaries are inconsequential and if, plus this, promotion is to be denied, if men who have served faith fully and efficiently are to be set aside at the behest of poli tical hucksters who in turn are dominated by corporation powers behind the throne, then contempt for the judiciary will soon reach the danger point. Such appointments as Butler's will cause a demand for the people to elect their judges and with 4' right to recall them.
