ATTACK BY MOB PLANNED Members of Company Testifies as to Remarks Overheard at Pool Room Durham, N. C., Aug. 2.-Eniphati cally reiterating their original state ments to the effect that they were fired upon before they fired, and add ing to them evidence of threats made against them, along with sworn state ments concerning plans of a mob to attack, seventeen officers and enlisted men of the Durham machine gun com pany today submitted their defense for a gun battle at the Alamance county jail in Graham on Monday t night, July 19, in which James Ray was killed and two other men were wounded, to a court of inquiry re cently appointed by Governor Thomas W. Bickett. The court of inquiry, made up of 1 Col. A. 11. Boyden, of Salisbury; Gen. I B. S. Royster, of Oxford, and Judge I W. 11. Whedbee, of Greenville, arrived ' in Durham early this morning and I convened in the superior court room of the county courthouse at 10 o'clock. Early in the hearing many prominent Durham citizens were put on the witness stand to testify to the character of the soldiers called as witnesses. Each soldier who testi fied was declared to be of good char acter. Major L. P. McLendon, who commanded Battery C, 113th Field! Artillery, of the Thirtieth division, in overseas service, lauded Lieut. Bar- I bour, who was a member of his out- q fit. He said that he was one of the [ most level-headed and at the same time one of the most fearless men in his company. Lieut. Barbour, he said, was seriously wounded in action pnd was later decorated for bravery.
