CHARLESTONIAN ON BENCH United States District Judge Henry A. M. Smith Concurs in Decision. Asheville, N. C. July 19.-An in junction issued by United States Dis trict Judge Dayton recently at Phillip pi, W. Va., restraining the Baltimore and Ohio and all other railroads east of the Mississippi river from distribut uting .special coal cars in the mining territory as an emergency step in the face of the present coal shortage was stayed and suspended here today by the United States Circuit Court of Appeals. The order was written by Judge J. C. Pritchard, of this city senior cir cuit 'judge presiding and 'concurred in by Circuit Judges Knapp of Washing ton, D. C., and Charles A. Woods, of Marion, S. C., and United States Dis-' trict Judge Henry A. M. Smith, of Charleston, S. C., sitting in an ad visory capacity. Under the order of the District Court Judlge Dayton, the- injunction was to have become effective Tuesday ihorn ing. Unable to Reach Decision Tonight after devoting almost twvo days to the motion for appeals, the circuit judlges were unable to reach * a decision. Realizing that the order would become effective in a fewv hours and taking cognizance of its far reaching r'esult, they dlecided to stay and suspended the injunction until the app1eal is finally dleterminedl. The title of the case was the Baltimore and Ohio Railroad ap pellant vs, the Lambert Run Coal Company. George M. Moffhcimer, of Clarksburg W. 'Va., and Herbert R. Poston, of Baltimore, for the appeall ant, and by John A. Howard, of Wheeling, W. Va., and Rush C. Butler and Frank E. Harkness, of Chicago, for the appellant. T.e railroads are said to have sent the special cars to'the mining dis tricts undor the order issued by the Interstate Commerce Commission. This order was the chief point of dis cussion, the commission holding it was empowered to issue such an order un der se9tion 15 of the interstate com merce laws. -- -o JUDGE DIRECTS VERDICT York, July 19.-Judge Ernest Moore, presiding in the Court of Common Pleas here, directed a verdict for the plaintiff in the case of Henry Massey, against the Massachusetts Bonding Company, in the sum of $7, 500 and interest, dating' May 29, 1919. The suit was to recover the face value of a policy that Henry Massey promi nent Rock Hill planter, held on the life of his son, Burton Massey who wvas killed by a Seaboard Air Line freighft train at Catawba Junction, S. C.
