Gough pastor of the Man ning Baptist church, preached the Baccalaureate sermon to the students of the Greenville Female College in Greenville last Sunday night. The work is being done in Day ment for convicts from the council to the chaingang. The town has a few hired hands on the streets also but they do not do as much work as the convict labor. Hagood, Esq., of Charleston were in Manning last Mon day looking after the payment of claims against the school funds of this county in the matter of the school charts. The town council is distributing dis infectants and a sanitary ordinance to the residents of this town. We hope people will take the printed ordinance and post it in a conspicuous place and then use every effort to comply with its provisions, and that the council will also enforce the ordinance regardless of consequences, and without respect to persons. If it suits- a man to keep a filthy cow or hog pen against the health conditions of our town. the council should make the lesson one which he will not forget soon. B. Loryea Drug Store, Isaac M. Loryea, Prop. Died yesterday morning in this town Mrs. J. S. Downing, a lady who was a stranaer here. Her husband was en gage in the lumber business in George town, and that city not agreeing with his wife, he sacrificed his business and moved to Manning. Mrs. Downing's condition seemed to improve until an other malady seized her, and with all that a devoted husband and kind neighbors could do she breathed her last yesterday morning. She was 28 years old. The funeral took place this morning in Manning cemetery. Seven Years in Bed. " Will wonders ever cease-?" inquire the friends of Mrs. L. Pease of Lawrence. Kan. They knew she had been unable to leave her bed in seveti years on account of kidney and liver trouble, nervous prostration and gcneral debility: "Three bottles of Electric Bitters en abled me to walk," she writes. Mrs. Florenqe Bradham, wife of Mr. R. J. Bradham, aged about 40 years answered the sum mons. The funeral took place in the Manning cemetery Rev. J. 0. Gough conducting the service. The grave was surrounded by sorrowing relatives and friends who with bowed heads and heavy hearts listened at the solemn services. This death is peculiarly sad because the deceased was much be loved and her being taken away from nine children the youngest an infant, carries a gloom into that motherless household which will be sorely felt. There has for sometime been a move ment on foot to secure better railroad facilities for this place, and the au thorities have been disposed to do something for us, but the difficulty has been to effect a schedule which would not entail a great loss. In convers~a tion with a high official the writer wtas told that on the 10th, inst., a change would take place which would give this town a daily freight service with accommodation car attached, but on account of their being no certainty, we refrained from saying anything about it prefering to wait until the proper authorities had acted. On last Monday Ia new schedule went into effect, which Igives us a freight service with coach attached both ways. Train 82 going to Sumter leaves Manning 7:20 a. m. and train 83 to lanes leaves Manning 9:55 a. m. arriving at Lanes 11:55 a. m. This gives passengers going towards Florence the relief from having to spend the night at Lanes. Passengers taking 83 catch a mail train at Lanes at 5:55, arriving in Charleston 7:40 p. m. We had hoped the authorities could have seen their way clear to have 83 connect with train 51 from Florence which passes Lanes 11:16 a. m. this would put passengers from here in Charleston at 1 o'clock p. in. giving them several hours to transact business without having tg stay in Charleston two nights. We believe the railroad people will do this by shortening up the schedules; as it is now, the tramn for Charleston passes 39 minutes before the freight on this road gets to Lanes, which we believe will be remedied shortly, as we know that Mr. J. R. Kenly the General Manager of the -Coast Line is disposed to be as accom -odating to the public as the earnings of the road will.permnit. Stepped Into Live Coals. His Honor 0. W. Buchannon opened the summer term here last Monday morning with the usual preliminaries attending the opening a court of gen eral sessions. The grand jury after being charged brought in true bills in the following cases: Eugene Lowry, murder. The pris oner was arraigned. William Jackson, Burglary and Lar ceny tried and found not guilty. Adger Bowman Larceny of live stock, pleaded guilty and sentenced to 9 months on ch: ' gang. S. C. Williams and William Pack Assault and Battery high and aggra vated nature, in two cases, one in which the defendants are charged with as saulting Mr. I. B. White, and the other is where Miss Lizzie White was the victim of the defendants wrath. The trial of these cases were merged into one as they are the outcome of the same difficulty. We know of no case that has ever been tried in this court house which was more deplorable; re spectable people and neighbors to be thus embroiled is to be regretted and it is a great pity for all concerned that an amicable adjustment of their trou bles was not arranged before the case got into the court. The trial took up a good part of Monday and was not con cluded until yesterday. The jury ren dered verdict of not guilty. George Epperson who was tried, con victed and sentenced at the last term, and who, through counsel succeeded in securing the enforcement of sen tence suspended, in order to give him a chance to pay the fine, had not paid the promised fine and was surrendered by his bondsmen and put on the chaingang to serve a sentence of 3 months. Robt. A. White one of the bondsmen went after and arrested Epperson in Camden. Lewis Griffin charged with grand larceny pleaded guilty, and was sen tenced to one year on chaingang. Frank Reed convicted assault and battery of high and aggravated nature. sentenced to pay a fine of $40 or serve 3 months on chaingang. The case of Eugene Lowry for murder begun yesterday, verdict not yet ren dered. There were true bills found in the cases of Tom Kelly for assault with in tent to kill and carrying a concealed weapon and against Charles A. Brad ham and Martha McCall for adultery. 1 GRAND JURY PRESENTMENT. To the Hon. O. W. Buchanan, Presid- I ing Judge, June Term of Court, 1901: 1 We, the grand jury drawn for the year 1901, would beg to hand you this our second presentment: First-All bills of indictment handed us by the solicitor have had our careful attention and reports have been made thereon. At the last term of court a committee was appointed to investigate the con dition of the county jail, court house I and records. This committee will re port at next term of court their findings as to the county records. We find that the court house is kept in fair condition, but the county jail is in deplorable condition-a disgrace to our county and civilization. We are aware of the fact that the ouestion of a 1 new jail was submitted to the people at the last election and voted down, be- 1 cause comparatively few of the voters of this county have ever been in the jail to inspect it and very few know anything of its condition. ff they knew the present condition of it not another year would pass before they would pe- 1 tition our Representatives for a new jail at the earliest time possible to se ure same. We ask our Representa tives to try to formulate some plan by which they can secure for us a new. jail without burdening our people with too much taxes. We can assure our Representatives 1 that any action taken by them towards securing a new jail will be approved by every decent and respectable person im 1 Clarendon county. We feel positive that no respectable voter of this county would oppose or even vote against a new jail if they~ would spend ten minutes inspecting the1 present one. This is a matter of great and grave importance and we sincerely hope our 1 Representatives will investigate it and take immediate steps looking toward some legislation at the next meeting of the General Assembly. We have been handed by the honor able Court charges made against a cer tain magistrate of this county, and not 1 having the time to give this matter the proper attention at this term of court, we have appointed a committee to in-1 vestigate same consisting of Messrs. R. J. Alderman, R. S. Fleming, W. T. Blackwell, I. J. Tomlinson, and A. I. Barron. This committee will report its findings to us at next term of court. All matters brought before the grand jury not herein reported upon will be reported at next term of court. A charge brought before the grand jury at the last term of court, charging1 the County Commissioners with having. committed an illegal act, has had our careful consideration. We appointed 1 a committee to investigate and report at this term of court. We find, through legal advise, that the County Commis- 1 sioners did not, commit an illegal act, but we have found by an investigation as follows, hereto attached and made part of this presentment: Manning, S. C., May 24, 1901. We, the committee appointed by the grand jury of Clarendon county at the< March term of court to investigate the 1 matter of Public Printing, find: I. Two members of the Board of County Commissioners appeared before 1 us andi stated their reasons for award ing the public printing to "The Man ning Times," Mr. Louis Appelt, editor t and proprietor, for the sum of $225, when they had made them a bid by The Manning'Publishing Company, as fol- 1 lows:1 "We ask at your hands that all pub lic printing for this county be offereda to both papers alike, each getting one-i half the usual prices paid. Should this plan not be acceptable to your honor able Board, then we would make as our bid, one-half the prices now prevailing, and do all the printing, binding our selves under any reasonable contract. S.-In case your Board requires, a definite bid, intending to give the3 printing to the lowest bidder, regard less of the above proposition, then we would make our figures for the entire printing for one hundred and fifty ($150) dollars." They stated that their reason for do ing so'was that they did not consider "The Farmer," printed by the Man ning Publishing Company, to be an es tablished paper, but we find that they did not investigate to ascertain if it was a responsible paper and could carry out any contract or contracts it made. We had to appear before us the lirectors of the Manning Publishing ompany, and they showed beyond a loubt that the company, a corporation 3hartered under the laws of the State. ,vas, at the time of this contract and still is, financially able to carry out any 4 .ontract it deems proper to make, and .an give a bond for. thirty thousand lollars, if necessary, to fulfill any con :ract it makes. The Grand Jury as a Poultice Maker. 4 The grand jury was called upon to nvestigate a complaint made at the pring term alleging that the County 4 .ommissioners had committed an ille- 4 al act in awarding the county print ng, and a committee from that body 4 onsisting of A. I. Barron, R. J. Alder-s nan and E. P. Geddings was appointed o investigate the complaint. This sub- 4 ommittee made an investigation as 4 heir report shows, and they found that he complaint was not true. The Coun- 4 y Commissioners did not commit an 4 llegal act. But this committee went urther. and looked into the financial 4 -esponsibility of the stockholders of the danning Publishing Company, and und the members of that corpora- 4 ion able to give a bond for "thirty . housand dollars if necessary," and )ecause the people owning stock in 4 ,be Manning Publishing Company are 4 >ossessed of wealth, the committee eached the conclusion that the Com- 4 nissioners did not exercise proper dis retion or economy in the matter of warding the county printing. It is not often that a finding of a rand jury is criticised, but we have Lo hesitancy in criticising this one, for 4 he reason that its findings was a dis nissal of the complaint Todged with hem against the Commissioners as un- 4 ounded in fact, but in going beyond 4 he complaint they were required to A nvestigate, they advertise the finan ial responsibility of not the Manning 4 Xublishing Corapany, but some of the A eople who own stock in it, which has ~ othing to do with the case unless the 4 ~rand jury felt it to be its duty to pro-. ~ide an ointment to sooth a soreness a f disappointment.. 4 The editor of this paper claims that A he Commissioners did use proper bus ness discretion in awarding the print-4 ng, because they gave the printing toA newspaper which had the advantage 3 if years of establishment, a fixed circu-4 ation and a satisfactory service, at a ate cheaper than the rates allowed by 2 The newspaper applying for the ounty printing and failed to get it had een in existence about fifteen months .nd during that short life had changed ands and editors several times, un ii it became a corporation with a apital stock of $3,000, made up of umerous stockholders who are only -esponsible for their stock-this is what tock companies are for-to limit liabil ty. Therefore, a man may be worth a nilion dollars and only own five dollars n stock-his liability only reaches his tock. But the Commissioners were iot called upon to investigate the lia iity of a stock company, and no pub ic record shows such .liability. The uestion for the Commissioners was, hich paper in their judgment had uch a circulation as warranted them n selecting a medium'for advertising heir notices. TL.ay, believing THE VIANNING TIMES, being an old estab ished paper and naturally had a fixed irculation, as business men, awarded he contract accordingly. The capital stock of a newspaper is ts circulation; this point which, for he purposes of investigation seems to iave been ignored by the committee, i it did not attempt to ascertain any hing relating to that point, unless they -elied on the ex-parte statements of the irectors interested in the corporation. e know the committee sought no in ormation from us, and it is needless to ay that it takes years of hard work to ~stablish a fixed circulation for a news-* aper, and no newspaper in thc be inning of its career can possibly have he same advertising value as one old stablished. The grand jury exonerates the Coun ,y Commissioners from the complaint harged against them and they had iothing whatever to do with, whether he stockholders of the Manning Pub ishing Company can give a bond of ' thirty thousand dollars," no mor'e han if we had gone before them and oasted that we could give a bond for ;ixty thousand dollars.
