BOND ACT UNDER WHICH ELECTION ORDERED TUESDAY ( Continued From Page 1.) f berry county, the same to be-laid out. and constructed along such routesand of such materials, in such order* and in such manner as the said com-] mission shall deem most advisable and best for the interest of the county. In the location of the said highways the said commission shall have the right to use, or to lay out new roads or relocate old roads, as they may deem best. They shall j have the same power and authority to condemn lands for the location of new roads or to relocate the old roads as is now vested by law in the board of county commissioners, the said nnwer to be exercised in the same X ? ? manner and under the same regulations as are prescribed by law for the exercise of the same by the board of county commissioners. Sec. 10. The said commission shall, in the selection of the roads or highways to be improved, and in the location of new roads, have regard, so far as may be practicable, for the established routes of travel and the demands of the population in the various parts of the county. Sec. 11. The said commission shall employ a competent and efficient road building engineer and such assistants and at such compensation as they deem proper, the necessary expenses of such engineer and assistants, as well as their compensation, to be paid out of the said funds. The highway commission shall also fix the compensation to be paid its clerk. Such engineer shall be known as the county engineer, j Such engineer shall have charge of | organizing and managing the con, struction, maintenance and repair of the roads, highways and bridges of the county and shall have adequate authority and full responsibility for the construction, maintenance of roads, highways and bridges under the general supervision and direction of said highway commission: Provided, That his duties shall be con' " < 1 -1 3 fined to rue roaas, mgnways a;m bridges to be constructed from the proceeds of said bond issue until the highway commission succeeds to the duties of the county supervisor and county commissioners. Sec. 12. The said commission shall, so far as practicable, let out all work upon contracts, and all contracts let shall be to the lowest responsible bidder after due advertisement of the letting of any contract. The work shall proceed so far as practicable simultaneously in different portions of the county, so that all portions of the county may enjoy the benefits of the same as soon as possible. Sec. 13. The members of the said commission shall enter into bond with sureties as provided by law in the t sum of $2,000 each, conditional upon the faithful performance of their duties as such commissioners, the premiums on said bonds to be paid out of said funds. Sec. *14. The said^ commission shall keep books, setting forth all contracts made by it for the construction or repair of said roads, which books shall be open-vfor public inspection at all reasonable times. 'l'ney snan aiso present amiuau^ uu the circuit court of Newberry county an itemized statement of all funds received and discharged by them, which report shall be a part of the records of said court. ? Sec. 15. The interest accruing on the funds arising from the sale of ] the said bonds while deposited in the banks of Newberry county as hereinabove provided, shall be by the treasurer of said county applied co the payment of the first year's interest payment on the said bonds so far as it shall* go, and any balance which may accumulate thereafter on such account shall be added to tne pnnci-1 pal of the said sum to be expended i by the said commission as hereinabove provided. ; Sec. 16. The expense of conducting the election on the issuance of said bonds shall be paid out of the current funds of Newberry county upon the warrant of the supervisor and board of county commissioners. Sec. 17. No member of said highway" commission shall take a contract to furnish labor or material for, the public improvements authorized un/Joy* tVnc Sec. 18. This act shall go into ef-! feet immediately upon its passage and approval by the governor. Sec. 19.
