Section I. lie it enacted by the <
General Assembly of tiie State of i
South Carolina: The Highway Com- <
mission of Newberry county, created <
by an Act passed at the present session
of the General Assembly and hereinafter
referred to as the "Com- :
mission.'' is hereby authorized to ;
order an election to be held at the
usual voting- precincts in said county <
on the 24th day of August, 1U20,
upon the question of issuing coupon
bonds of Newberry county in the ;
amount of four hundred thousand
dollars ($400,000.00) for the pur- :
pose of constructing and imp rovinghighways
and bridges in said county. The
commissioners of election for .
state and county officers for Newberry
county shall appoint the managers
and receive and tabulate the re- ;

elections in this state. The validity !<
of said election and the correctness; 1

election by the managers shall not be j (
open to question in any court except i e
in a suit, action or proceeding com-! i
menced within thirty days after the ; i
filing of said report as aforesaid. j <
Sec. 2. The managers of said elec-. 1
tion shall serve without compensa- j
tion. \ j i
Sec. 3. A sufficient number of bal-; i
lots shall be provided for use at said, c
election according to law. At said i
election, all qualified electors of t
Newberry county shall be entitled toji

issue of said bonds shall cast a bal-;

The delivery of bonds so executed a
shall be valid notwithstanding any a
changes in officers or seal occurring c
after execution. The bonds shall be
sold upon sealed bids submitted pur-'a
suant to notice published at leact }
once at least ten days before the sale L
in a newspaper published in New-i
berry county, and pursuant to such i
further advertisement, if any, as the
commission may direct. The bonds
shall be sold for not less than par and
accrued interest to the date of delivery.
The bonds shall be exempt
from all State, county, municipal and
school taxes.
Sec. 5. Until the principal and in-'
terest of all bonds issued under the;
authority of this Act shall be fully j
paid, there shall be levied annually j
on all taxable property of Newberry (
county a tax sufficient to pay such }
principal and interest as they re- \
spectively become due. The said j
annual tax shall be levied and collect- (
ed in the same manner as other taxes <.
for county purposes, and shall be t
levied by the county auditor and col-\ i
lected by the county treasurer or j
by such other county officers as may 1
have the power to levy or collect any s
tax for county purposes in Newberry c
county. The said tax shall be applied s
to the payment of said principal and c
interest as they respectively become c

Sec. 6. The funds arising from c

and constructed or improved along
such routes and of such materials,
in such order and in such manner as

Sec. 10. The interest accruing on
he funds arising from the sale of

Sec. 11. The expense of conduct-!
ng the election on the issue of said

unds of Newberry county. i
Sec. 12. No member of the said
ommission shall take a contract or
urnish labor or material for the pubic
improvements authorized' under
his Act.
Sec. 13. The said commission;
hall, so far as practicable, let out
11 work upon contracts, and all con-!
tacts let shall be to the lowest,
esponsible bidder, after due adver-!
isement of the letting of any con-,
ract. The work shall proceed so far
s practicable simultaneously in dif-j
erent portions of the county, so that!
11 portions of the county may enjoy;
he benefits of the same as soon as,

Sec. 14. The members of the said
ommission shall enter into bond with
ureties as provided by law in the sum

ty, according to and in proportion to
the combined capital stock and sur- 2
plus of each bank as nearly as may
be practicable at a rate of interest
of not less than 4 per centum, per
annum from the date of the deposit
until the funds are withdrawn from
time to time by the highway commission
as needed by them in the performance
of their duties under this
act. Said fund shall be paid by the
treasurer upon the warrant of the

Should any bank or banks in said
county decline to receive such deposit

rata share of deposits due to such

to accept same shall be deposited

shall be withdrawn from such banks
as they are deposited with in an impartial
manner and proportionately
to the amount held in deposit by the
various banks in so far as practicable.
Sec. 8. The highway commission
of Newberry county shall be composed
of one member from each
township of said county, to be elected
as now provided for in case of
other county officers in the election
herein provided for on the question
of issuing: said bonds for a term ending
January 1, 1925, and said commission
when so elected shall elect
one of their number chairman and a
clerk who need not be a member of
the commission. Should any vacancy
occur in the said commission it shall
toe filled as now provided by law in
case of a vacancy on the present j
board of county commissioners. The J
chairman of said commission shall I
receive, as compensation for his serv-1
ices, a salary of $500 per year, and j
the other . members of the commis-j
sion the sum of $5 per day foi each j
day actually engaged in the duties j

Their successors shall be elected at
the general election in 1924 and
every four years thereafter.
