important measures passed by the recent
general assembly is the Banks'
state warehouse insurance act, which j
is now 011 the governor's desk await- j <

provide for the insurance of state 1

warehouses and state warehouse cot-,
ton bv the state, tlie premiums to be ;
collected by the warehouse commisi
sioner and placed in the state treas- i
j ury, and any loss tc be paid by the '
state treasurer upon warrant drawn'
i by the state warehouse commissioner, i
from said funds or any other funds J
in the treasury to the credit of the '
state sinking fund commission, whicn ;;
now insures certain classes of public i
property. The state .warehouse com- ;
missioner would be required to rein- j'
sure any single risk of over $100,000. j:
The rate of insurance would be fixed I
by the warehouee commissioner, sud- i
ject to the approval of the governor, i
j insurance commissioner and comptrolj
ler general. The idea in placing the !
j funds already to the credit of the;
i sinking fund commission at the dis-!
( posal of the warehouse commissioner
| to pay any loss is that a loss might
occur before the premiums earned
from warehouse insurance would be
i sufficient to meet it. j

Several days ago the sinking fund ,
, commission held a meeting to conI
sider the effect of the act. and it was
feared that certain trust funds held
by the commission might be affected.

In reply thereto I beg to say that ! ?
the portions of the sinking fund held j(
by the commission in trust for the I
bondholders and creditors of the state j g
and in trust for the public schools of ,
the state can not be affected in any j
way bv this act. These trust funds ;

have been dedicated by the state con- j
stitution or the acts under which the
state funds are issued to the use1
therein declared and can not be di- j
verted by subsequent acts of the leg- j
islature.
The provision in section 5 of tbi3 j
act now under consideration that any 1
loss of cotton by fire shall be charge'!
against said funds or any other funds
in the hands of the sinking fund com- I
mission must be held to mean any insurane
funds held 'by the sinking
fund commission for the purpose of
meeting fire insurance losses. The
accumulative fnnds from premiums
paid on insurance of state. county
and school buildings are the private
property of the state and may be disposed
of by it as it sees fit. It is,
[herei'ore. no violation of any pubilc
trust to use these funds as a guarantee
fund for the purpose of private insurance
to persons storing cotton in
lhe state warehouse in addition to the
insurance provided ?->r the public
buildings now being insured under
ixisting laws.
