The State.
Of immediate and acute inter st to
the people of South Carolina, is the
language of a part of rh second
. clause of the second section of Article
I II of the constitution of the l"nited
States, relating to (he powers and
duties the president, as follows:

judges of the supreme court, and all

and "appointing'' various judges,
V commissioners, collectors of revenue,
marshals and district attorneys.
W It is not necessary to say to any
man of common intelligence that the
I power of "nominating" and "appointf
ing" these officers is not given to "the
' senate/' much the less is it given to
one senator, or the two senators of a
Scate.
i Collectors, district attorneys and
marshals are not officers of South
Carolina. They are officers of the
United States. It is merely accidental
that the territory of South Carolina
! and a certain federal district are co
| incident.
r However there may have grown
up, as an incident to party government,
a thecry and practice of "senatorial
courtesy" whereby it is attempted to
deprive the president of his power of
nomination and appointment, it has
[foundation in neither law nor reason.
In more than one State and in more
than one administration the attempt
(sometimes successful) to rob the
president of his powers by a combi
.nation, which might better be called
V conspiracy, of senators has reached
w the proportions of a scandal. There
was no excuse for the attempt of the
i late Senator Roscoe Conkling and "Me
?
Too" Piatt to run roughshod over
President Garfield and nullify 'his
power of appointing officers of the
United States in New York. There is
^ less in a time when the senate, by
the adoption of the seventeenth
W" amendment, has been taught its retn

O'Gorman, Senator Smith, Senator
Tillman, or any other senator,to undertake
to "nominate" to President
Wilson one of their friends and bully
him with the threat that unless fte
"nominates" that one hack :o the senate,

" officer as the president may himself
exercise.
The limitation "by and with th* advice
and consent of the senate'' is
"wise and purposeful. It was placed
in the constitution, that the senate

man proved to be unworthy, that the
senate might correct a mistake of the
t \ president, but (mark the order of the
words) it was provided, first, fhat the
president should "nominate'' and then
that the senate should advise as to the
acceptance of the nomination.
Shall the order be reversed? Shall
a senatorial conspiracy calling itself
"courtesy" appropriate the substance
of the appointing power and l^ave the
president the shadow?the senate,

hamper the executive in order that
senators may appropriate to themI
! selves and their friends the patronage
: and leave the executive to answer for
their good or bad behavior.
But the efforts persist. The president
is defied. "Tb*s appointment belongs
to me; you shall appoint this
man or that or you shall appoint
none" declares, not "the senate" but
a senator, with the insolently add^
word that "we'll see to it that 'senatorial
courtesy' rebuffs and humiliates
you unless you toe the mark as I
draw it."
And what is the fate of popular
| government? Where do the people
I "come in?" A dozen excellent men
may wish to be collector of internal
; revenue. Shall they seek appo?*"' >ont
j from the president? What is the ?se
| when senators, not satisfied with their
i own offices and sala^es, proscribe all
j save their personal favorites?
i The people of South Carolina did
j noc know when they elected senators
that they were voting for marshals,

j thought that their president would j
jattend to the filling of these offices.
Nor would they be pleased in the
event of the election of a senator unfriendly
to the democrat in the White
House, that he be allowed to scuttle
the national demo<iTatic administration.
Furthermore, these senators may
take warning that some hundreds of
active and strong democrats in South

I friends resent the fact that senators
have cut them off from urging their
claims upon the president. These
would have asked nothing more than |
j a fair field before the president, car!
rying to him their indorsements, and
this fair field they can't get because
their senators sha-ke the bludgeon of
"senatorial courtesy" before th? president's
eyes with one hand and shove
them back with the other. Meanwhile
a wretched squabble makes a sovereign
commonwealth ridiculous.
