PETITION DENIED.
Garlington and Young Must Serve Sen
tences Imposed-Send Down
Remittitur.
Denying the petition for a rehearing
and revoking the order staying the
remittitur, the supreme court Friday
wrote the last chopter in the Semi
nole Securities case, and unless an ap
peal is taken to the United States su
preme court John Y. Garlington and
James Stobo Young, former officers of
thle company, should enter the State
penitentiary to begin the service of
terms of three years and one year re
spectively. The two defendants, both
residents of Laurens, were convicted
more than a year ago in the Richland
county court on the charge of breach
of trust, involving approximately
S55,000.
John Y. Garlington, who spent Fri
day at his home in Laurens, had no
statement to make. It is said that Mr.
Young is in Chicago, in charge of tWe
business of the two, and that he will
return to the State.
The order of the supreme court was
addressed to J. Frost Walker, clerk of
court of Richland county. The two de
fendants are each under bond of $5,
000. It is said that a petition for par
don was filed with the governor from
Laurens county.
Following conviction in the Rich
land county court Garlington and
Young appealed to the supreme court.
Several weeks ago the supreme court
gave a decision affirming the Rich
land court. A petition was then filed
asking that the remittitur be stayed
and that a rehearing of the case be
granted. The remittitur was stayed
and after reviewing the petition the
supreme court yesterday signed the
following order:
"After due consideration we discov
er no ground for a rehearing. It is
therefore ordered that stay of remit
titur heretofore granted be revoked
and the petition herein b;e dismissed.
