Attorney General Lyon has given an
interesting and important opinion in
connection with the marriage license
law enacted at the last session of the
general assembly and which went into
effect on July 1.' He has ruled that
a license may be issued by the clerk
of court or the probate judge as the
case may be, upon the presentation of
the proper affidavit sworn to before a
notary public and that with this affi
davit it is not necessai-y for the con
tracting parties to appear before the
officer issuing t ie license. The opinion
L was given upon the request of S. H.
Rodgers, the clerk of court of Beau
L fort county. The opinion says:
"In response will say that it is my
opinion that the statement under oath
or affirmation, required by section 2
of the act, may be made by any person
having knowledge of the facts, be
fore a notary, and that such statement
under oath or airmation, is sufficient
to authorize the clerk of couft or pro- a
bate judge, as the case may be, to is
sue the marriage license. It is not
necessary, under the terms of this act,
that either, of the contracting parties r
appear before the officer who issues
the license, but the license may be is-.
