OITY COUCIL RE-OPENS
POWER CO. FRANCHISE

oonference with Mr. W. S. Lee, vice
iresident of the company, who has
just returned to his office from a bus
iness trip to New York City. After
his conference with Mr. Lee, I wish
to state fhat the rranchise under
which the Southern Power company
*perates, and to say that it has been
tarefully drawn with a view to being
:air. I can only reiterate what I said
at its last meeting, that however de
sirable our entrance into the city of
Newberry might be, it could not be
eufficiently attractive to us to warrant
our destroying a policy which it has
taken years to build up, and jeopar
dizing an investment such as we have.
It will be impossible, therefore, for
us to accept any modifications in this
dranchise whatever. As I stated to
you at your meeting, it is our inten-,
tion, should this franchise be granted,
*o build our sub-station in your city,
but under no circumstances would we
-4ermit this to be a part of our fran
phise or to be an inducement toward
the granting of it.
In regard to the resale clause, your
city has it within its power to .pre
Tent any one selliny power in com
petition with your lighting plant in
your city by refusing to grant such
competitor a franchise. On the other
hand, our company, being under the
wontrol of the public service commis
sion of the State of South Carolina,
it becomes our duty to serve all ap
plicants alike .and by mandamus we,
*an be forced to do so, so that so far
as we are concerned the resae clause
could have absolutely no effect, be
oause of the power of the public ser
vice commission to require us to serve
all applicant-in the same manner.
I wish further to add, that while it
is not our desire to hurry you in
these matters, nevertheless we would
like to know at the earliest possible
moment whether or not it is your pur
pose to grant the franchise as asked
for, as we must determine within a
very short time whether or not we
will build our lines to Newberry, or
whether we will change our route, go
* ing via Clinton and Laurens and
thence to Greenwood. This must be
* ~ deternmined within the next few days.
I hope you understand that the posi
tion we have taken is not an arbitrary
one, but is a matter of buisiness with
us, as I aim sure it will be with you.
If your people feel that the Southern
Power company offers advantages to
a growing community, you have the
opportunity of securing these advan
tages. If, however, they feel khat it
does enot offer such, no harm whateverI
has been done. In fact; we believe
that it is better policy for the South
ern Power company to seek only those
fields for doing b5usiness that earnest?
ly wish the company to do business
with them, and that even though we
could obtain an entrance into New
berry without your good wishes, it
would be- better for us not to come
unless we had your cooperation and
support.

Wanted City Attorney Present.
Alderman Earhardt said that this
- com.munication was more,. courteous
than -anything that had yet been pre
sented to council by the Southern
Power company, but, in his opinion,
there were legal questions involved
which would have to be taken 'np, and
inasmuch as City Attorney Eugene S.
Blease was out of town, and, there
fore, not present at the .meeting, he
would not be willing to go into the
matter of re-opening the question of
granting a franchise to the Southern
Power company, as the council would
desire, and should have, advice on the
legal questions involved.
Prosperity's Resolutions Presented.
Mayor Langford then presented a
resolution, which 'had; been adopted
by the Commercial League of Prosper
ity, and whi.ch had been received by
-him with request that it be. submitted
to city council.
The following is the action of the
Commercial League of Prosperity:
Whereas the entrance of the South
ern Power company into the city of
Newberry, would in all probability
further the material advancement of
Nowberry and contiguous territory.
1. Therefore be it resolved that the
Commercial League .ot Prosperity,
hereby express the hocpe that the
council of city of Newoerry may come
to some agreement ghereby the said
Southern Power company may enter
said city.
2. That the secretary of this league
transmit their action to the Honorable
Mayor and Council of the city of yew
berr-y.

franchise to the Southern Power co.n
pany and of letting it come into New
berry.
Mills Anxious For Power.
Alderman Goree said that he would
like to know if city council could
grant the franchise to the Southern
Power company, to supply power to
the cotton mills and not to distrib
ute it to any other persons in the city
of Newberry. He said that the cot
ton mis of Newberry were greatly
interested in this matter, and espec
ially was this true of the Newberry
Cotton mills as the Newberry Cotton.
Mills had arranged in their No. 3 mill
to secure power from this company,
and at present they did not have suf
flient power to operate the machinery,
and it would entail a considerable ex
pense for them to get power other
wise, and he was anxious, if there was
any way by which the Southern Pow
er company could come in for this
purpose, to let them in. He had been
opposed to granting a franchise to
the Southern Power company without
inserting a maximum rate, but he un
derstood that the Newberry Cotton
Mills were holding off securing addi
tional power until this matter of a
franchise to the Southern Power com
pany had been determined.
Mayor: Langford stated that under
the franchise which was proposed not
permitting Southern Power company
to sell power in less than 100 horse
power, would probably limit the use
of this power to the cotton mills.
Notion to Reopen Matter.
Up to this time there had been no
motion bafore council, and Alderman
Lominack moved that city council re
open the question, and take up the
consideration of granting the fran
chise. He said that we were crip
pling our enterprises by holding the
Southern Power company out, and he
thought that a franclise . should be
granted to them, and.he saw no rea
son why council should not take the
matter up, and settle the question at
once.
Mayor Langford seconded the mo
tion of Aiderman Lominack to take
up the consideration of the franchise
to the Southern Power company.
Mr. F. H. Dominick Present.
Mr. F. H. Dominick, who was pres
ent, was asked if he desired to sub
mit any matter to".uncil, and he re
plied that he haad heard that council
might consider some. matters affecting
some of. his clients, and he had come
down at their request to see what
was to be done. He was not present
to oppose the franchise of the South
ern Power company. His clients, he
said, would not be affected one wray
or a other by the granting of a. fran
chise by city council.
Alderman Earhardt insisted that his
reason for opposing the consideration
of the matter at this time was, as
stated, that in all probability legal
questions would be raised, and he
thought when action was' taken that
the city attorney should be present
so as to advise council on these legal
questions, such as-th'e question as to
strems and other maters.
Mayor Langford stated that the
matter war, preseute-l by Mr. Taylor,
representing the Southern Power
company and council could see what
he had to zay.
Aldef.man Earhardt sa id that coun
cil wa.s there as a representative of
the people, and it was their business
to protect the rights or the people c1
Newberry.
Matter Reopened.
The question was put on the motion
of Alderman Lominack to take up the
consideration of the franchise, and
was adopted by a vote of 4 to 2 as
follows:
Yeas-Mayor Langford, Aldermen
Lominack, Summer and Goree.
Nays--Aldermen Earhardt and Rod
elsperger.
Alderman Summer said that the let
ter of Mr. Taylor was before council,
but the question as to whether the
Southern Power company will accept
any amendments was not settled, and
'City Attorney Blease had stated that
any agreement mad.e between the city
and the Southern Power company as
to the rights of the Southern Power
company and the city, which were not
in the, franchise, would not tbe as
good as if they were in the franchise.
In other words, the proposition of the
Southern Power company to agree to
build sub-stations in the cithlimits,
and not to distribute power in less
quantities than 100 horse power; if
that agreement was it. the presence
of witnesses but not in the franchise,
would it be binding?
Thought Proposition Absurd?
Alderman Earhardt said that the
proposition was absurd. If the South
ern Power company was willing to
agree to these propositions of coun
cil, it ought to be willing to have
these agreements a part of the fran
chise; otherwise they would amount
to nothing as all of the witnesses
might be dead when any questions af
fecting the agreement came up.
