Judge Prince referred Farnum' failure to testify at the former tria] saying that his silence indicated hi determination not to .commit perjury "In this instance," said the judge "you have come up like a man an< admitted your guilt. These matter .appeal to the court and besides yoi are not a State officer; you are a pri vate citizen and did not have the re sponsibility that rested on these gen tlemen who -had to discharge dutie devolving upon them by law in th conduct of the State dispensary These things all appeal to me to b lenient and I am going to be reason :ably lenienit, but not so lenient a. your counsel would like me to be; tean not see it just as they would se it, possibly, but I am going to take ii consideration your plea. The sentene is that you be fined $5,000 or be con fed at hard labor on the publi works of Richland .county or in th State penitentiary for a period oi one year.'" Sentence Amended. When the jifdge had- finished Mr Bhagood said that the defendan would immediately pay his fine. "In that case," said Juidge Prince "I 'will amend the sentence befor it is entered." . Mr. Hagood then turned over a cer tiflate of deposit from the People'! National bank of Charleston, fo: $5,000. It was dated yesterday. Other Cases Dropped. The next step was to submit a order, which had already been type written, diseharging Farnum and hi sureties from farther liability in th remaining three eases against Far num. This order sets forth that thesi -eases are nol prossed by consent o the -attorney general. The order fol lows: State of South Carolina, County o Richla.d: In the court of genera sessions. The State vs. James S. Farnum bribery. The State vs. James S. Farnum, e al., conspiracy (two eases). ,The attorney g>naral having statei that it is his intention to nol pro the remaining indictments pending i this court against James S. Farnun and also having stated -th'at it is ii intention to not T ros, so far sas th defendant, James S. Farnum, is corn *cerned, those cases pending in thi eourt - wherein the defendant Jame S. Farnum is indicted with others fo conspiracy. No.w, on motion of B. A. Hagood attorney for James S. Farnum, it i .rdered, That the said James S. Far -num and the sureties on the severa recognizanees given; by him for hi appearance to meet the charges con tain.ed in the said cases, are diseharg ed from further liability thereon an< the said James S. Noti a State's Witness. * The agreement under which th< cases against Farnum are to be -no prossed applies to all cases in whiel he is a defe'ndeant, both those in Rieh land and in Chester, for bribery an' conspiracy. In the other eases pend .ing against State' dispensary official F.arnum cannot be made to testify however, as he has constitutic~aal im munity on the ground ,that his testi money might tend to ineriminate him It is understood that F:irnum ha positively refused to testifyv agains hais former friends, just as he refus ed to take the stand and perjure him self by denying that he had givet 'bribes or rebates. His pleas of guil ty, however, is a 'omplete adnissio1 of the allegations of corruptior <brought against the State dispensara system. The Expedient Course. 'The indictment is as follows: 'The grand jurors do present tha at the times hereinafter men'tiones one Jamxes S. Farnum was the agen of the divers persons and cor:pora tions who were engaged in the busi ness of selling liquors, whiskeys 'wings, and beers, and that at sai( times one Joseph B. Wylie held at office and position of trust and pro fit in the State of South Ca rolina, t. wit: A member of the board of di rectors of the State dispensary of th ta of South Carolina, and as sue] - times charged with the duty of par - member of such board was at said - chasing liquors, whiskies, wines, and i beers for the said State dispensary. "And the grand jurors afroesaid, upon their oaths aforesaid, do furth, er present, that the said James S. Farnum and' the said Joseph B. Wy i lie and divers other persons to the grand jurors aforesaid unkInown, at Columbia court house, in the county i of Richland in the State of South Carolina, on the sixth day of March ' in the year of our lord one thousand - nine hundred and six, and on divers - dates before and since said time, the - said Jas. S. Fariam being then and there the agent of said divers per sons and corporations for the sale of liquors, whiskeys, wines, and beers as aforesaid, and the said Joseph B. Wylie being then and there a mem ber of said board of directors as aforesaid, they, the said James S. Farnum and Joseph B. Wylie and I other divers persons to the grand a jury aforesaid unknown, unlawfully - did then and there conspire, combine, confederate, and agree together to -have the said Joseph B. Wylie accept and receive a certain sum of money, to wit, the sum of $1,575, a more particular descriptioa thereof being to the grand jurors aforesaid un known, as and for rebates on certain liquors, whiskeys, wines, and beers sold and to be sold to the said State dispensary of South Carolina by the said divers persons and corporations through and' by their said agent, the said James S. Farnum, a more par ticular description of. said rebates and sales being to the grand jurors aforesaid unknown, which said -bums of money as and for rebates as afore said, were to be accepted and receiv ed by the said Joseph B. Wylie for his, the said Jos. B. Wylie and divers other peirsons to the grand jurors aforesaid unknown individual use and beneit and not for the benefit and in behalf of the State of South Caro liaa, to the evil example of all oth ers in like case offending and against th., peate and dignity of the State of South Carolna."
