New and Large School Building to Replace at Once Building Which was Burned. Excelsioi, January 30.-Mr. Ar thur Lee Wheeler, who is clerking at Newberry, spent Sunday with his fath er's family in this section. Mr. A. M. Counts is building a ten ant house on the public road. fr. Ira Nates, of Columbia, spent Sunday with his father's family, Mr. A. A. Nates. Our teacher. Miss Sudie Boulware, will spend her short vacation with her father's family. Our new Sunday school organ is expected to come in any day. As was mentioned in Tuesday's Herald and News. Excelsior school house was burned down early Monday morning. Mr. J. D. Stone, who lives near. was the first to discover the fire, and when he reached the building he found the fire house. Mr. Stone and his son entered the house and got out the library, th' teacher's chair and desk, and one stove. The other contents were con sumed in the fire. There were Sun day school. and preaching service by the Rev. Ira S. Caldwell on Sunday afternoon. The building was insured for $300. The trustees and patrons of the school called a meeting on Monday night, and at this meeting it was decided to re place the house at once, and lumber will be placed on the ground this week and work will soon commence. It is the plan of the trustees and pat rons to put up a much larger build ing than the old one, and also to build the new house facing the public road. The trustees and 'patrons of the school return thanks to the Prosperity graded school for their kind invitation to use one of their rooms until they could rebuild, but this invitation and one or two others were found too invoneenient for the smaller children, and at the meet ing Monday nighit it was decided to shut down the school until the new ~building could be put up. If th-e weather is not too rough it is ex peeted and hoped the new school house will beC ready for school to re open at home again in two or three weeks' time. Sigma. C0THRAN AND CAREY CLASH. Disagree Before Supreme Court as to Interpretation of Law They Jointly Drafted. Columjbia Record. It is not alwVays that Messrs. Carey and Cothran work in perfect unison. Whild they worked ftogethrer for mahv moons and evolved the now celebrateds Carey'-Cothran law, they dio not agree entirely on the con struction of their handiwork. This was demonstrated yesterday in the discussion of the case of the state vs. J. R. Small, in the supreme ceourt. This was a case started orig inally in the mayor's court- of Eas iler, where the appellant was indicted for violation of the Carey-Cothran law. -He was 4efended by the :firm of Cothran, Dean & C'thran, of Greenvillet The case .went against the defendant and was appealed first to the Eire'uit eoflit and then to the supreme court!. iThg town auht'ori ties employed J. P. Carey, Esq., to prosecute the case and yesterday at the bar of the supreme court these famous legislators strove manfully to impress their interpretation of their lm' unon the supreme tribu-I 'nal of the state. Mr. Jpstice Jones was at once impressed with the pe .euliarity of the case and] called at tention to the fact that these authors were contrary minded, as to tire con struction of their own law'. "It is said a house divided against itself cannot stand.'" promptly re olied Mr. C-othran. "and I hope it. won't stand in this case.'' It will ibe interesting to watch the putcome of this case, just to see which one of the fathers of this 'bill will triumph in his interpretations placed upon it in this case NEWS oF PROSPERITY. Evans. had the misfortune to have his hand caught in the saw and had his hand and wrist 'badly cut up. He will lose all the fingers of his hand except the middle finger. He bled seriously and tire attendin' physicians. Drs. Hunter and Wheeler. had some trou ble to get. the flow .f blood stopped. He is very weak from the loss of blood. Dominick has been vn a visit to his brother, Prof. Boinest Dominick, at Fountain Inn. in Green ville county. Dr. Wyche returned to his legisla tive duties Tuesday morning. lessrs. W. E. Moseley. Arthur Pugh, S. B. Bowers, and Forrest Bed enbaugh attended the "Heir to the Hoorah" Wednesday evening. The Bank of Prosperity is put ting in a nice new oak anl plate glass front. This will certainly be an im provement over the old one. and will make it one of the handsomest bank buildings in the county. New furni ture will be installed and the general appearance will be greatly improved. Mr. L. A. Black, of Leesville, was in town on Monday and it is reported that he will go into the mercantile business here. Rev. M. 0. J. Kreps and Mr. A. H. Kohn will go to Charleston on Satur day to present the mission work of the South Carolina Synod to St. An drews and 'St. Matthews churches, on Sunday. Pastor Kreps' pulpit will be filled by Rev. Z. W. Bedenbaugh. Mr. J. A. Blackwelder, of Newber ry, was in town for a few hours Wed nesday. HIe says he is not going to move to Columbia, as was reported he would do when h found the pot of gold. Having already found the gold, there is nothing further to be desired, and he says Newberry is good enough for him. Dr. and Mrs. C. K. The Calhoun .conty election is valid The supreme court has said so. - The court dismissed the writ of certiorari, which was argued las week, and thus upholds the validit3 of the -election. The judgment of the Court is unanimous. The Court', decision is not given in full and th reasons will be filed later. but the decision is handed down promptli p-erhaps for the reason that the cour realizes that to delay would be t< prevent the matter being passed 01 by the general assembly at this ses sion. A bill establishing the nev county. as required by the constitu tion, will now be introduced am passed. and Calhoun county will bi a verity.
