Suit Against Dispensary Commission
for $7,000 Hoard?The 'Claims
Made.

In Richmond yesterday Attorney
General Lyon opened argument before
Judge 1'rite hard ixf the United
States district court in tho injunction
proceedings brought by Garrett
& Co. of Norfolk, Vn., and Weldon,
N. C., in which claims in the hands
of the state dispensary commission
are tied up. The arguments will be
concluded some time today and the
decision of the court) will be awaited
with much interest on account of the
$700,000 involved in other claims
now in the hands of this commission.
It will be recalled that sonic days
ago tho wine firm of Garrett" & Co.
applied to Judge Pritehard for a
temporary injunction, holding up all
payments until the Garrett claims
could be heard. This paper states
thai about $7,000 is due tho (inn by
the commission ami it is alleged that
although several offers have been
made t he commission for a sell lenient,
all of them have been refused
and that the commission shipped back
to Norfolk several thousand dollars'
worth of wines which have been refused
and are not fit for use.
The answer filed by tho attorney
general and Mr. W. F. Stevenson, the
attorney for tho commission, says
that the conimision decided to hold
up all claims against the dispensary
until further evidence, wanted on account
of the prosecutions that may
follow, is produced and that no intention
of defrauding the debtors of
their just dues has been intimated.
The answer further states in many
instances the firm bringing the suit
has not complied with the law and
filed the proper bonds required under
lite old law and therefore is entitled

The wine 'linn alleged that the appeal
was made in the United Stales
court because of ihe fact that the
commission would claim that ihe firm
had no right to sue Ihe agents of the
stale.
A special from Richmond yesterday
says:
"Attorney General Lyon of South
Carolina opened argument before
Judge l'ritchard in Ihe United States
district court here, today on the injunction
of Garrett & Co. against the
South Carolin dispensary commission.
Tho commission is represented by Attorney
W. E. Douglas of North Carolina.
General Lyon will conclude
his argument tomorrow morning, commencing
at 10 o'clock for Ihe commission.
The purpose of the injunction
is to force the dispensary com1
mission to repay damages resulting
from the closing of the dispensary.
Tho damages aro estimated between
$0,000 and $7,000. The case will bo
concluded probably tomorrow."

President Roosevelt proposed this
memorial in a lei tor on Lee's birthday

Confederate Memorial association.
The idea has gained high favor,
both in tho South and the North, and
an organization is about to be formed
Co promolo it. The idea in the
minds of Dr. Denny and Mr. Heyward
is to have it in the form of an
endowment to Washington and Lee
university, of which Gen. Leo was
president, which was named in part
for him and where he is buried.

hiibition bill, 152 to 2, Spragins and 1

adopted with but one dissenting vole, (

bill was called. ,
When two car loads of Mobile wo- I
men came to the city today to lobby (
against the prohibition bill, passed
by the house and pending in the senate,
they found that delegations from
Montgomery, Selma and Birmingham
who favor tho prohibition nreasure (

crowd them out and carried. Little '
children stood in the lobbies and '
pin.led ribbons on every one who
came in. The children were kepi out
of school to work against whiskey.
