General W. A. Anderson stated today i
that Saturday's capitulation of the i
railroads is not, as is generally sup- >
posed, an end to the rate question between
the railroads and the state, for
the stipulations of the truce have yet
to be executed. "The purpose and
effect of the arrangement between the
representatives of the railroads and
the representatives of the state," said
Maj. Anderson, "are to expedite a
prompt decision of the important
question presented by these cases by
the, supreme court of the United
States in such a manner as to arouse
as little friction and antagonism as
possible.
"While the rates prescribed by the
state corporation commission for passenger
travel are to continue in force
until the final decision of the suits
the main questions in the cases remain
to be decided. These involve
the validity and effectiveness of the
state corporation commission and the
right and power of the state to effectively
regulate the railroads of the
state. They involve also the right of
the inferior courts of the United
States and the judges of said courts ?
to enjoin judicial tribunals from pre- (
scribing the rates and adopting rcgu- |
lations for the government of rail- ]
roads and other public service companies
in respect to the duties such
companies owe the public. The main
questions arising in the cases are, as
will be seen, of vastly more importance
than whether there shall be a ,
2-cent or a 3-cent fare for passengers.
The rates prescribed by the state cor- '
poration commission are to be put in- i
to effect not later than Oct. 1, and
continue in force until the suits, shall 1
be finally decided. The state filed
pleas and demurrers in the cases in
the United States circuit today."

AN ASSAULT IN NEW YORK.

Exaggerated.
New York, Aug. 5.?One of the J
most brutal of recent crimes against i
women and children was today charged
against Luca Fontza, who was
locked up at New Brighton, Staten
Island, accused of assaulting Antoin- ^
ette Talcua, the two-year-old daugh- ,
ter of Mr. and Mrs. Pasquale Talcui,
of New Brighton.
Fontaza and Talcui are both laborers
employed at the King plaster
mills in New Brighton and Fontza ,
boarded with the Talcuis. Fontza
was left with the little child today '
while Mi's. Talcui went shopping. The j
mother had not gone far from the <
house when the child's screams
brought her back. When lie saw Mrs.
Talcui, Fontza rushed from the house
Mrs. Talcui following him. Her cries t
brought out the neighbors and soon
a mob was following the flying Italian
down the street. The pursuers
soon overtook the man and he was
knocked to the ground, where he was
severely beaten and kicked by men
and women until a policeman appeared
and with club and revolver fought
off the crowd.
The cnild on the. orders of a magistrate
was examined by a physician
who reported that the child was seriously
injured. Fontza was held in
$5,000 bail on a charge of criminal
assault.
Agoline Pondarti, a six-year-old
child, was found terribly bruised in
a thicket near the village of Linolcumville,
Staten Island, this evening.
She had been attacked by an unknown
man.
John Ambrato, ah Italian laborer,
was arrested in Brooklyn this afternoon
on a charge of attempted assault
on two little girls.
Daniel Lalor and Frank P. Body
were arrainged on similar charges.
Deputy Police Commissioner
O'Keefe, who was in charge of the
police department during the absence
<>f Commissioner Bingham, today asked
the mayor and board of estimate
and appropriations 1 v funds to employ
an additional policemen. The
request will be aetefl on Wednesday.
Most of the crimes are committed
in little frequented places. Mothers
throughout the city are terror-stricken
and incidents, which under ordinary
circumstances would be passed
over without a second thought arc
magnified and reported as crimes,
which have little foundation .in fact.

there is not an unusual number of 1
assaults but several murders within
the last few weeks and the hysterical
condition of the people, particularly '
in the tenement districts, have cans- ,
j ed reports to the police of cases of
which, under ordinary circumstances,
they would never hear.
