A NEW DISTRICT ATTORNEY. Ernest F Cochran of Anderson, Appointed to Succeed John G. Caperi Whose Term Expired Capt. John G. Capers s own an-i out as United States district attornev. 'Thursdav President Rooseveh appointed E" I I rnest F. Cochran, of Anderson. his success or. Mr. Cochran was not an appli cant for the place, but the presi (lent knew him as a candidate for the judgeship should another judge be provided for, and he was evi dently iimpressed by the high testi monials which had been presented in his behalf. The failure of Mr. Capers to receive reappointment is the consequence of the investigation made by the agents of the depart ment of justice. It is learned that one of the prin cipal charges against Mr. Capers is that he was reported to be retained by the Richland Distilling company in a suit in which that company is defendant against a distiller in Asheville. The Richland Distilling company is liable to be brought in to the United States court as a de fendant, in which case it would be the duty of the district attorney to prosecute it. The legislative dis pensary investigating committee caused the distillery to be investiga ted by the United States internal revenue officers, and it is said that it was found to be violating the laws of the United States. so that at the very time the district attorney was acting as the attorney of the distil lerv, it was committing acts for which it might any day become his duty as an official of the govern ment to prosecute it. WHAT CAPT. CAPERS SAYS. When seen in Greenville Mr.. Capers would have nothing to say about his future plans, or whether he intended to resign as a national republican .committeeman. Mr. Capers said he had seen the pub lished statements that charges had been filed against him, 'but that he knew nothing further about it, that. he did not know the author or au thors of the charges,. or to what they referred, whether personal or official, and had never received a line officially as to the alleged charges from any of the authorities 1 in Washington. "I should think, however," Mr. 'Capers added, "that there should be. some way to ascertain what the charges are and who made them. I shall certainly s'pare no pains to find '1 that much out, regardless of the office, for there is no four year term to a man's character of which I amn aware.' IR. AIKEN FILED. CHARGES. Representative Wyatt Aiken is1 the man through whom chargesi were filed against the appointment of John G. Capers as district attor ney, says the Washington corres pondent of the State. This he1 stated and gave .his reasonS. "Some time ago," he said, "I came to the conclusion that Capt. Capers was not the man for such a place. th. \it wvas a great injustice to the stais >o both democrats and repub licans, to have him in an office of such responsibility. Nunmerouis persons complained to me aind I have no doubt complained to other representatives about it and as no1 one else seemed to take the matter up, I determined to. do it, and as I do not wish to be thought half hearted in this or anything else, you may say that for several months I have pursued the subject persistent ly and relentlessly." Here Mr. Aiken stopped, then after a little added: "And vou might say I have called on the president and the attorney general a number of times and I have placed with them all the letters and corn plaints that have come to me." "What other charges besides the! one connecting him with the dis - tilling company were filed ?" Mr. Aiken was asked. -"Oh, it is not necessary to go into' that. I will only say that they are' of a public nature concerning his actions as district attorney and es pecially as republican referee for South Carolina. There were all~ sorts of complaints about the ap-. pointments he recommended, but* there is no use to go into particu- p ars.
