I find that the note of $iooo.oo ti the Bank of Prosperity has bee pledged by it, in due course of busi ness, as security for its debts, but a to whom so pledged, or the natur of the transfer there was no testi mony. I do not find that council hav threatened to pay the $iooo.oo not to the Bank of Prosperity exclusive ly out of the taxes of the town, as th testimony will sustain the lindini that it was cuuncil's purpose to pa: this debt, as well as all others, ou of the general income whether th same be collected from taxes, rentE licenses, fines. or otherwise. I find that the plaintiffs. or a least sonqe of them. kiew of tM purchase of the lot, saw the buildinj being erected upon it. knew of th creation and existence of the debt ti the Palmetto Bank & Trust Co., an: of other debts, or ought to havy known of theim or could have know: of them. That itemized statement of the receipts and expenditures o the town, includinrg the cost of lo and town hall. market house ani guard house, before their congpletio3 and before the transfer of the deb~ from the Palmetto Bank & Trust Cc to the Bank of Prosperity, were pub dished or posted, in the newspaper o at public places in said towvn eac: quarter for the information of th< citizens of the town of- Prosperity That besides showing the receipt and expenditures, these published o posted statements also contained; showing of the indebtedness of th town and to whom due, and plaintiff could, upon application, have easil: scertained the indebtedness of :th town from its clerk and treasurer,i they did not otherwise.know,an~d.ha< no other source from which to ge this information. It does not appea that plaintiffs ever complained t< council tif the expenditures of mone; for the erection of this building, bu that they acquiesced in its erecio: and the contracting of the debts du to this unusual expeoditure, of -whici they must have ignown. As to th advisability, as to the absolute neces sity, of the erection of a guard hous< market house, meeting place. fo council where they might transac the business of the town, room fo the storing and k-eeping the tools a the town, there can be no contradic tion. And the testimony shows tha the town of Prosperity, with its 8o inhabitants. 20 odd 'business houses one-half dozen or more churches high school for whites, school fo colored children. two railroads. tw, banks, a cotton oil mill, two liver and sale stables, telephone systerr telegraph office. t-we railroad depots one hotel, dispensary, 'an ntteliigen community, surrounded by a- pros perous county, and steadily growing could dot have well:afforded to hav The Wonderful Egg Producer. The v reat increase in pro duction vf eggs has given s .'International Poultrv Food", wonderful reputation all over every State. We guarantee that it cannot be fed to hens at any time, winter or sum mer, without showing a large e increase in eggs. You do not have to use the food at an extra expense because it will make you more monev after deducting its cost. One ext ra egg per month wili pay the entire cost of feeding it and often more than doubles the supply. It contains no poison ous or injurious ingredients and bas very superior merits. It Gives a Glossy Plumage. It prevents sickness, pro motes good health, causes young chicks to grow very rapidly, invigorates the diges f hL tive organs, supplies material for bone, muscle and feathers, and is very beneficial during moulting season. It invig 1 orates the egg producing or gans and hens will lay more and longer. It will prepare your chick 1 ens for the market more rap idly than any other prepara tion and has been used for years by prominent chicken f breeders. where its citizens might meet and where public entertainments might I be held. These were the motives and - reasons, as it appears, why council, e as they thought supported by the best citizenship of the town, went for - ward, without hindrance, in their work in the erection of this building. It might be said that the building was erected at actual cost, that is, at - a colt for the la-bor performed and at 1 first cost price of the material, furni 1 ture, fixtures, and other furnishings r of the building. The town hall is t being used by the entire population ) of the town, by plaintiffs as well as defendants, the market house is a wonderful irrl, rovenient over the old t ie. and brings in good rent, and the rd house is a terror to the evil r (i__ 3 of an otherwise peaceful town. SJust such a guard house is an abso > lute necessity. In appearance, this I building is an ornamentt. the town. 3 Its apartments are well arranged and; I answer the demands of the place. Respectfully submitted, f Henry C. Holloway, Referee 2Wo 62.02.
