GOOD LOOKS DONT COUNT. Unique Decision By Judge Parker, of New York. Atlanta Constitution. Members of the bar are discussing a recent dicision by Judge Alton B. Parker, chief justice of the court of appdals. of New York. Judge Par ker has decided that there shall be no compensation in damages for good looks in a woman. The case is a very unique one and has caused more attention because of the fact that Chief Justice Parker is so prominently mentioned as a dem ocratic candidate for president of the United States. Anything that Judge Parker has to say now is sure to attract attention. as is the case with all men who are mentioned in high public life. The Lawgiver for July contains a notice of the case referred to. The case was that of a man whose wife had been killed and he was suing for damages. When the case was heard before a jury, the woman's photo graph was exhibited to the jurors. She was a remarkably pretty woman, and when the jurors had gazed upon her lovely face they went out and made up a verdict in favor of the husband, giving a large amount for damages. Judge Parker's Ruling. When the case was carried to the New York court of appeals, Judge Parker made the following ruling: "The court erred in admitting in evidence the photograph of the de ceased. The action was to recover for pecuniary injuries re?ulting from decedent's death. Such injuries are to be compensated on the basis of the monetary value of the services of the deceased to her husband and chil dren. The introduction in evidence of the photograph of a handsome wo man could not be expected to ac complish any other result than to introduce the personal element for the consideration of the jury." In commenting on Judge Parker's decision, The Lawgiver says: "In other words, the law rules out all evidence as to the attractiveness and physical charms of a wife lost in circumstances that give rise to a claim that she was young, strong. healthy, for damages. In fact, the preparedness of the Japanese, the precision of their move ments, the unerring working out of their plans, no less than the calm con fidence of their soldierly, is enough to strike terror to the hearts of their toes.
