As to nil the sophistry' that has been urged, in relation tQ-the consiiiutronality of such proceeding, f liokJ hfm coatehiptiblefor argument, ?nd utterly unworthy of serious refuth'ton. The Constitution has nothing to do with it: it is .'a quertiop of pol cy or expediency entirely. Indeed, so faT from qu Atoning the right of th^J^cgislaturelo abolish ami prohibit the retail System, I think, if. any constitut onal question can be made at all, it might much moro rationally bo doubted whether it had a consp:u ional competency to establish a system, sofraiFgh^iojjh efti/s of the most per* nicious charatAerl But; as it has been established, there can be no doubt that the Legislature has the same right to repeal and prohibit, that--it had to ordain it; or, in o'htr words, the same right, by law, to promote the principles (if public decency and morality, that it* has by law, to overrun the Siate the great evil of Intemperance, and all its attendant train of crimes ?nd vices. It m not the Constitution, iherefore, that constitutes the difficulty. That is meretya pretext to cover the tru" reason; arid ifn; true re ?son, is that "public opinion is not yet sufficiently strong, or orgaoiz d, to jus'ity the measure.
