GENERAL ORDER NO. 8.
I THE GENERAL ASSEMBLY OF THIg
State, by an Act, entitled "An Act for the better
organization of tbe militia, and for other purposes " having
vacated the cumuiissions of all militia officers of this
State who are not exempt from sei vico by the Acts of
the Confederate Congress, as soon as new elections can
be held, elections are hereby ordered to be held for
field and cotni any officers, in all the companies, battalions
and regiments of the militia of this State, on or
before the twenty-first day of this month; said elections
to be conducted in the manner prescribed by the act of
1841, except as to the notice required under said act.
II. No one liable to duty in the Confederate serservice,
unless he be exempted from said service under
thu provisions of the exemptions act of Congress,
shall bo eligible to said offices.
III. The officers in command of regiments at the
time said elections are held, are required to make
returns thereof to this office immediately thereafter.
IV. The commanding officers ofcoinoanies and re
giments aro hereby required, immediately after said
elections have beeu held, to make returns of the rclls
of the companies promptly to this office, in pursuance
of the provisions of the fifth and sixth sections of said
act, herewith published; and for default in making said
returns, the penalties therein imposed will be strictly
enforced.
V. The commanding officers of regiments are hereby
charged with the prompt execution of this order
on the publication thereof.

Extract from the Act oj the General Assembly for the
better Organization of the Militia.
Sec. 5. That the commanding officers of beat companies
shall keep two seperate rolls?one of the names
of all persons resident in their beats between the ages
of sixteen and sixty, and another of the names of all
persons between the ages of sixteen and fifty, designating
on said roll the ages of each person; and all persons
required to be enrolled by this act. shall, immedi
atoly after its passage, report their names to the commanding
officers or their beats, who shall have power
to administer oaths as to the ages and residences of
persons, when they refuse to make known their age
or place of residence, or where there may be doubts as
to either, and each and every beat company shall be
called out for drill and instruction onoe every two
months.
Sec. 6. That the commanding officers of companies,
as soon as said enrollment can be made, shall return
said rolls to the commanding officers of their regiments,
who shall return the same, within ten days, to the
office of the Adjutant and Inspector-General; and for
default in making saic^returns, the {commanding officers
of companies shall be liable to a fine of fifty dollars,
and commanding officers of regiments to a fine of one
hundred dollars, to be imposed by a court martial ordered
by the Governor for the trial of such defaulters.

Sec. 18. That all commissions held by the militia
officers of this State, except the Adjutant and Inspector-General,
who are not exempt from service by
the Conscription act of tho Confederate Congress,
be and the same are hereby vacated as soon as new
elections can be held, which elections the Adjutant
and Inspector-General is hereby instructed to order
immediately after the passing of .this act; end that no
i oneJLUnb.le to duty in tha Confederate service, unless
' he be .exempted from said service under the provisions
of rt.be Exemption Act of Congress, shall be hereafter
eligible to aoy militia office.
