LETTER AND JUDGE ALDRICH'S ADDRESS.
Governor Orr hug rcceutly addressed ft letter
(o tho President, in which he earnestly
protests against General Canby's recent Jury
order, aud ask* that it tnny either be entirely
revoked or be suspended until tho termination
of the full terms tif tho Courts. The letter
presents a forcible exposition of the evil? which
must result from the enforcement of tho order,
aud vindicates the correctness of his conclu
siuu, that "if carried into oxecutioo, this general
order will more completely unsettle the
laws reluting to perrons and property, than
nil other orders which hare 3'ct been issued by
tho Military authorities of this District,"
Judge A Id rich, in his address to tho Court
at Edgefield decliues to obey tho order, upou
the ground that it conflict* with his oath of
office, requiring him, to the best of his ability,
"to discharge the duties of his office, and proserve,
protect and defend the Constitution of
Ibis State, and that of the United States," and
alio so far as he "may bo concerned in the
drawing, balloting, tmpanntling or suinviomtig
juri*?, truly, diligently und uprightly, to carry
into due and faithful effect, the Act of the General
Assembly, commonly called the Jury Law,
passed A. D. 1831, as the anme has since been
altered and amended."
By complying with (he order the Judge believe*
that he would be lending It in sanction
10 the usurpations of the present Congress in
their attaaka upon the Federal and State Cooatitntious,
at the same time that ha would fail
to eaforea the law of the State, which require*
that the juror ba a while mala citizeu or foreign
emigrant who has given notice of his intention,
been a resident of ihe State for one
year, and in addition, be a tax-payer on property
in bia own right.
Evan under the Reconstruction Act itself,
lu?re is nothing to justify the recent assumption
of authority by Geo. Canby. It contains
prov isioas aa to suffrage and office but nothing
as to ibe qualifications of jurors. Other and

?that it proscribes a large mass of tlie intelligence
of the State simply on the grouud of
past political opinions?that it exclude? all
who have failed or declined to register?that
it destroys the property qualifioatioD, end admits
to the jury all who muy have paid a capitation
tax?that vhilst excluding a large
number of the white raoe, it opens a wide door
to the ignorant and pauper black race, thus
v enabling them in some Districts entirely to
control the lives and property of tho whites.
On this point read the forcible exposition of
the Governor:
There are white msjorities in but six districts.
In two distriots tho numbers are about
equni. in each of the remaining twenty-three
districts of the Stat*?there being altogether
.hirty-one? tha registration shows a coloured
majority. In Charleston, the coloured majority
it 1812, tha registered whites being 328C,
and the blacks 6098. Of the whiles 118 were
unable lo sign their names ; of the colonred
2606. In Charleaton and Columbia a larger
number of the latter clan of parsons can read
and writ*, than in an; other portion of the
State, a very much larger number, bscause
they have had facilities before aud since emancipation
of obtaining some education not enjoyed
by their class in nil the rural region of
tha Stata, to which I shall advert more particularly
hereafter. In organizing a jury in
Charleston, therefore, uuuming that all have
**:d their tuxes, this proportion would give
nearly eight coloured jnrors to four whitea>
and five of these eight would not be able to
igu their names. In Beaufort, Georgetown,
Colleton, Berkeley, and other districts, the
allowing is even worse. Partial returns from
Beaufort indicate that litere ere 2550 coloured,
and but sixty-five while votes registered.?
This proportion would furnish but one white
man to every fourth jury. Of the coloured
voters registered iu the rural districts I estimate
that not more than five per cent. of the
whole number are able to lead and write, and
ery ninny of them have not intelligence
enough to count oue hundred. In Georgetown
District there are 418 whites aud 8413 coloured
voters registered. One while man might pcrehanee
be drawn upou each jury, aud in all
probability not one of the remaining elrven
coloured men would be able to read aud write.
To sum up, there will be in twenty-three
districts of this State h majority of coloured
jurois for the trial of a'l classes of cases, civil
and criminal, and only five per cent, of tl>eir
number mil be able to read or write. Does
any country which hue established the right of
trial by jury, fail, l?y its legislation, to secure
a proper deifVce At intelligence unions the juroral

Court*, will, I presume, be likewise applied to
the Federal Court; and the proportion upon
such Federal juries will be?iu Charleston,
eight coloured to four whites; in Columbia,

State* Court sit* in South Carolina.

he attributes chiefly to the revolutionary tendencies

lower in the markets of the world than that
of any Christian nntion in Europe. It hits
sunk to the level of thut of the Turk, the 'sick
man of the East.' When you look at the list
