At the Superior Court holden in
this town, the present week, came
on tor trial, tiie case of Pedda Day,
vs. John L. Dexter, for mal-prac
ticc as a surgeon. The evidence on
trial wai, Uut in the fall of 1815,
the defendant was called on to ex
amine^ slight syre on the ancle of
the plaintiff. The defendant pro
nounced a cancer, and said he could
cure it, and began to apply his caus
tics. By this application he eat and
destroyed the flesh and muscles to
Che^and, in cutting what he
and cords, and entirely destroyed
the use of the ancle and foot. It
appeared from the testimony of Dr.
T wichnell, and other surgeons, that
the soie, when Dexter began his Ap
plication, was nothing like a cancer;
and a surgeon of any knowledge
would have known it was not. That
the course of treatment By D. was
grossly improper, and an adver
tisement of Dr. D. published in
June, 1815, was rend in evidence,
where the Docror informed the pub
lic, that he could cure all disorders
subject to the human frame; and'
he had learnr of the Indians , &c.
The chief justice gave an excet?
lent charge to the jury; and direct
ed them, that if they Considered the
plaintiff's case proved, it was. their
. duty to give liberal damages. That
they should not only give sufficient;
to compensate the plaintiff for the
injury done, but also as a punish
ment to defendant.* That the pub
lic were interested that such gross
quackery and imposition should be
put down. -The jury gave a ver
dict for plaintiff for "400 dollars
damages.

,Gen Lee was remarkly slovenly
in his dress and manners ; and has
often by the meanness of his appear
ance, been subject to ridicule and
insult. He was once attending Gen.
Washington to a place distant from
the camp. Riding on hp arrived at
the house where they were to dine,
some time before the rest of the ?
company. He went directly to the
kitchen, and demanded something
to cat, when the cook taking him
for a servant, told him she would
give him some victuals in a mo-j
ment ? but he must help her i ff
with the pot. This he complied
with, and sat down to some cold
meat which she placed for him on
the dresser. She was remarkably
inquisitive about the guests, who
were -coming, particularly of Lee,
-rt who she said she had heard was one
of the " most oddest and ugliest men
in the world." In a few moments
she desired tl?e General again to as
sist her in placing on the pot, and
scarce had he finished, when she re
quested him to take a bucket and
go to the well. Lee made no ob
jection and began drawing the wa
ter. In the mean time Gen. Wash
? ington arrived, and an Aid de Camp
was dispatched in search of Lee ;
whom, to his great surprize, found
him engaged as above. But what
was the confusion of the poor girl
on hearing the Aid de Camp address
the man with whom she had been
so familiar, with the title of excel
lency. The mug fell from her hand
and dropping on her knees, she be
gan crying for pardon . when Lee,
who was very ready to see the im
propriety of his own conduct, but
never willing to change it, gave her
a crown ; and turning to the Aid de
Camp, observed, " You sec young
man the advantage of a fine coar ?
the man of consequence is indebted
to it for rcspect ; neither virtue nor
abilities without it^wjil make him
