the expense of breuking down public

of scholars, the College cannot he sustained.

December 20, 1807, I aiu Instructed by the
Commanding General to reply to your inqui.
rlos as follows:
You inquire, " where goods were sold on
commission in 1880, and settled for, prveions
to the pnssngo of tbo Aet of 18C0, is 20 cents
on the $160 to ho collected, or not?"
Although your Inquiry is confined to ensos
of sales on commission, where tbo proceeds
wore accounted for before the passage of tho
I Act, tho reply ia applicable to all other esses
embraced under the clause in question.
Assuming the facts, out of which yodr Inquiry
grows to be as stated by you, and it np. ;

passage of tho Act raising revenuo for the
your 1887, thore was no law In operation subjecting

Act on the subject, the rate of taxation

this easo the proper amount to collect is 20
rents on tho $100, that being tho amount fixed
by the lust law preceding that of December,
1880.
Your second inquiry is as follows: "Merchants
having dono business continuously on
tboirewn account, or for aecount of others,
daring 1808, delivering their goods as tlioy
sold them, are they to pay tho tnx of December,
1888, ss passed hy tho Legislature, or Is
their tax to bo scaled down to 20 cents on the
$1 00, or is no tax to be collected t"
Merchants doing business on their own account,
stand on tho satno footing with commission
luorchaut*. . Hales accompanied by
tbo transfer of property cflbctod by thoin,
prior to tho passage of tho Act of December
1(86, are not linbto to taxation, under the
provisions of that Act. As to this liability <>f
such transaction to the tax of 20 cents, an
answer line already been given, under your
first inquiry.
Yonr third inquiry relates to the proper rate
of chargeable taxation, in tho easo of newspaper
publishing.
Tho business of publishing and vending
newspapers, including the sale of advertising
space, is regarded as mercantile in its chamo
ter, anil accordingly tho provisions of tho
first clause of (louural Orders No. 02, arc npplicablo
to taxes, laid upon traaractious in the
course of such business. The rntes chargeable
upon the gross earnings of such establishments,
nre to bo fixed with reference to tho
principles hereinbefore laid down, in regnrd to
