Not many years ago a criminal caee '
was tried in an adjoining county, in
which one Ben -was a material
witness for the State. The charge was
that Foster made an attempt to kill otte 1
S. with a four pound weight. Bon 1
was a stout, strong man with huge
lungs, and not in the habit of refusing 1
a social drink with a friend. He was
only a tolorr.bly good natured fellow
when he bad " a brick in his hat." and
feasted on the details of a fisticuff with '
?reat relish. Ben was called up by
io State and politely requested to tell
all he knew about it. After squaring
himself round a time or two, and adjusting
his quid, he began in his peculiar,,
usual voice. i
" Well, we all went to the sale? 1
there was a big crowd thar?some was
drinkiug and some wan't?I was. Judge, 1
portar so myself. Well, Noel Holes J
was tbar tryin to buy an old spotted
sow that run cIuho to him. Noel is &
food feller, Judge, but he ain't smart;
e went to Jackson onst and bis dad- i
dy got out of sight, and be went about
axing every man he inet,1 whar's dad- 1
dy ?*" <
* ** Go on Mr. , tell us all about
the fight."
" Well, as I was say in, Noel want- ,
ed tho sow and was afeared he couldn't 1
buy her without gettin somebody to <
stand lor him, and I told hitn of he'd i
make me safe I'd go it or diej and he I
said he'd pawn his gun, but hit was at 1
Wingate's shop to be fixed. I told him J

squares with us, no liow. Well Noel 1
he :bid three dollars and a dime, an s
a quarter, and I can't say which, in
the positive."
u G<> 0", sir, if von ttlease, about the (
fight." " f
" Well, give me tube to bring it fl
round right. Well, Noel didn't git the t
sow, bekase John Wall bid inor'n she v
was wnth. Well then a cow was put t
up and Foster bid ten dollars and a 41
quarter and she was knocked off to him. 2
Foster said he only bid ten dollars, and s
9. said he bid ten and a quarter. Tbev
got tQ disputin and I thought enough
was said for a man to fight on, but l
Foster tuck it. They kept on jowerin, C
ntid fit last fS. told Foster he'd be ? s
of he'd 6crupulate. Fob said he'd be c
? ef he'd combolicate from what c
he said. Well, about this time I felt 1
dry and went over to the doggery with u
several and we all took a stiff drink, n
I tnck mine with sweetnin, Judge.?
Well Noel Hailes seemed hurt about
not gittin the sow, so I says, Noel, lets r
have some music to mako us feel bet- s
tcr. Sex he, Ben, I know you are a
friend to mc, and ef you'll git Abe j
Lard to play * Cotton eyed Joe,' I'll
treat to halt a pint. Well, in this time n
we hearn the 'fuss over the way and
went out, and who should we see but
S. lying down on the piezzer, and Foster
as pale as skimmed milk. Sez I ?
men, let's have a fair tight. Some one .
said. Ben, they've already fit."
" Mr. , did you see the fight?"
Well, I can't say as I did, nor I
can't say I didn't. I mought, then
again I inoughtn't." .
" Do you recollect anything about
it, or were von in a condition to recollect?"
J* ;
"Well, Squire, you rather got me ,
thar. The fact is, I sometimes git discombobolated,
and my demembrance
ain't very clare; but one thing I'm
sajre of, Judge, and that is, Noel treat- p
ed ; ef he didn't I'll bfi 1" ^
Here the State informed liirn that
h#-could stand aside, and the Court ?
not happening to hear the oath, the wit- "
neas was permitted to retire amid the
suppressel laughter of the whole court ,
room. ?
