D. 1875. to the first day of January, A. D. 1876. for the earns and in the man? ner hereinafter mentioned, shall be levied, collected and paid into the Treasury of eaid city for tbe nac and service thereof; that is to say: Section 1. Seo. 1. That eaoh and every person between tbe ages of 21 years and 45 years, liable to work on tbe streets of said city, may and shall be excused from tho performance of each duty on the payment of $2 to the City Clerk aud Treasurer; and, on failure to pay tbe said sum of 85, at the time of the payment of tbeir oity taxes, they shall, when summoned so to do, be required to work personally upon the streets of the said city for six days, under tbe direction of the Superintendent of tbe Streets, nr any other person appointed by the Mayor and Aldermen to take charge ol and direct them. Auy per? son refusing or neglecting to obey such summons shall be fined $2 for each day's negleot of the same, to bo reco? vered by information before tbo Mayor and Aldermen iu Coaucil assembled. And it shall be tbe duty of the City Clerk and Treasurer, and of the Chief of Polioe, to report to the said Mayor urn- Aldermen all defaulters under this eeotioo. Sec 5. That each aud every owner or tenant, or occupant of any real es? tate, upon any street where water is brought by pipes or otherwise from the city reservoir, shall pay to the City Treasury, at tbe same time with the other taxes imposed by this ordinance, a general tax of $1 for eaob fifty feet of frontage where there are buildings, and one oeut per foot of frontage where there ure no buildings upon lots so taxed: Provided, That every lot apon such streets upon whioh any snub structure or structures exist, shall pay a water tax of not less than $1: And provided further. That no proper? ty holder or teuantebull be charged for more thau one frontage for property owned or occupied by hiin. Seo. 6. All persons who shall enclose any streets or parts of streets in tbe oity of Columbia, by and with oonsent of tho Council, shall pay an annual rent of 85 on any street, or part cf any street, so enolosed, or such other price or sum as may be fixed and de? termined by tbe Coaucil; bat each street, or part of street, so enclosed by the cousent of Council, may at any? time bo opened by tho order of aaid Connoil. anything to the contrary herein notwithstanding. And the said Clerk and Assessor is hereby required to assess, collect and receive the taxes and duea levied and imposed by this ordinance, and all arrears of former taxes or due*, and make a re? turn thereof; ae well as a return of all persons who shall fail to make a re tnrn and pay the taxes herein and hereby imposed, on the 1st day of May next, or as soou thereafter as may be practicable. Suo 8. The said Assessor is hereby directed, in sssessiog for taxation the amount of sales likely to be mudo by any dealer dnricg the year 1875, to as? sume, if, in his discretion, it would be juat so to do, us a basis of hie estimate, tho amouut of such tales during the year 1874, according to the sworn re? turns thereof of the said dealers. ttr.c 9. That all returns of property, of every description, aud of all other tbings made by taxation a source of revenue to the said city by this ordi? nance, shall be made npon the oath of the tax-payer, which returns shall be made by filling out blank forms, to be furnished on application by the said Clerk and Treaanrer, on or before the 31st day of January, 1875, except as in thia ordioanoe otherwise provided; but thst time may b<' extended by the Mayor and Alder men; and the said re? turns shall embrace every subject or object of taxation, whether held by, or pertaining to, the tax-payer, in bis own right or in a fiduciary capacity. 8xo. 10. That all persons who may commence a permanent business in the city of Columbia subsequent to the time fixed for making tax returns, pay? ing the eity taxes aud procuring an? nual licenses, shall, after the lapse of one month from opening business, make returns to the City Clerk of the value of the stock and other property employed therein, and pay their taxes and lioenses; the taxes on the valoe of the said stock and other property to be oharged for the full fiscal year, but the lioenses to be paid in proportion to the remainder of the said year: Provided, however, That all transient dealers shall pay their full annual li? oenses to the close thereof. Seo. 11. That it ehall be, and it is hereby declared to be, the duty of the City Assessor to assess all the property named in this ordinance for city luxa? tion at a reasonable valuation, and the City Clerk aud Treasurer to collect the taxes levied thereon, and th? per cent, imposed upon all otber tbings as sources from wbioh a city revenue by this ordinance is direoted or coutoni plated to be raised, although not ape oifioally mentioned, according to the rates herein declared: Provided, hotr ever, That overy tax-payer shall have the right of appeal to the Mayor and to the Committee of Ways and Means from the assessment of the City Asses? sor for a revision thereof, in oase be should thereby feel himself aggrieved. Sec. 12. That in oase it should be? come necessary to issue un execution against tho property of the defaulting tax-payer, and to sell thereunder bis real property, in order to collect the taxes doe by him, it shall be the duty of the Mayor, and he is hereby em? powered so to do, in order to pot the purchaser thereof into immediate pos? session, to issne his warrant of eject? ment against the owner, or against bis lessee or lesaecu, or against any otber person or parsons who may be in pos? session thereof, and to place the said warrant in the bauds of the Chief ol Police, or auy other officer whom he shall sei.-et, who shall proceed without delay to execute the same, at the ex? pense and costs of the party or parties in default: Prornied, That the owner of the fee. bi.i les-.ee or lessees, shall not bo dt prived of the use and posses? sion for a longer period than two years from the day of sale. Sec. 13. That the Mayor aud Alder? men shall issue execution sgainst each and every pereou or corporation who shall be reported by the City Clerk and Treasurer to have failed, neglected or refused to make returns or pay the taxes imposed by this ordinanoe with? in the time herein prescribed; and all executions issued by the said Msyor and Aldermen shall have attached thereto the signatures of the Mayor and City Clerk and Treasurer and the seal of the city of Columbia, in the ! name of which such executions shall be entitled.
