Be it ordained by the Mayor and Al? dermen of the City of Columbia, in Coun? cil assembled, and by the authority of the same, That a tax to oovor the period from the first day of January, A. D. 1875, to the, first day of January, A. D. 1876, for the sums and in tho man ner hereinafter mentioned, Bhaii be levied, collected and paid iuto tbe Treasury of said city for tbe use aud serviae thereof; that is to say; Section 1. A tux of 8Uo on every hun? dred dollars in value of all real estate aud personal property of every descrip? tion, owned and used in the city of Colombia at any time during tho said fiscal year, shall be levied aud paid iuto the City Treasury for tbe use of the said city: Provided, howevert That no personal property not taxed or liable to be tax id by the State, shall be taxed for the service of the said city. Seo. 2. Io addition to the foregoing taxes, a special tax of $1.00 on every hundred dollars of the assessed value of all real and personal property oi every description, owned and used in the oity of Columbia at any time dur? ing the said fisoal year, shall bo levied and paid into tbe city Treasury, to be used for tbo purpose of paying tbe in? terest upon tbe public debt of said oity, as provided by Act of tho Gene? ral Assembly, entitled "An Act to au? thorize the Mayor and Aldermen .of the oity of Columbia to issue bonds, land to negotiate and sell the same," [approved March 13, 1872: Provided, huicever. That no personal property not taxed,.or liablo to be taxed by the State of Soutb Carolina, shall be taxed for the use of said oity. Seo. 3. There shall be paid on ve? hicles the following tax, viz: Upon each four-wheel pleasure carriage or barouche, drawn by two or moru horses, $20; upon carriage, buggy, ba? rouche, gig or sulky, (not used for hire.) drawn by one horse or mule, $10: Provided, That the value of pleasure carriages and other pleasure vehicles specifically taxed, be cot re- j quired to be returned for taxation as personal property. Upon eaoh ve-j biole used for the breaking or exhibit? ing of'norses or mules $25; upon each , express company's wagon, drawn by one horse, $10; drawn by two or more horses, $20: Providtd, That nothing herein contained shall be construed to extend to wagons, carts or other ve hiolea going to or from market, and owned by non-rebidents of said city, or of wagons exclusively usod for agri oulturul purposes. Seo. -1, That each and every person between tbe ages of 21 yeurs and -15 years, liable to work on tbe streets of said city, may and shull be exoused from tbe performance of such duty on the payment of $2 to the City Clerk and Treasurer; and, on failure to pay I tbo said'sum of $5, ut the time of tbe payment oi iueir ulijr taxes, they sbal!, I when summoned so to do, be required to work personally upon tho streets of the Baid oity for six days, under tbe direction of tbe Superintendent of tbe Streets, or any other person appointed by the Mayor and Aldermen to take charge of and direot them. Any per? son refusing or negleotiug to obey such summons shall be fined $2 for each day's neglect of tbe eame, to be reco? vered by information bsfere tbe Mayor aud Aldermen in Council assembled. And it shall bo the duty of the City Clerk and Treasurer, and of tbe Chief of Police, to report to tho suid Mayor aud Aldermen all defaulters under this section. SeO 5. That each and every owner or tenuut, or oooupuut of any real es? tate, upon any street where water is brought by pipes or otberwiBo from tbe city reservoir, shall puy to tbe City Treasury, at the same timo with the other taxes imposed by this ordinance, a general tax of $1 for euch fifty feot of froutago where there are buildings, and one oeut per foot of frontage where there uro no buildings upou lots so taxed: Provided, That every lot upon such streets upon which any such struoture or structures exist, shall pay a water tax of not less than $1: And provided further, That no proper? ty holder or tenantshall beohargedfor more than one frontage for property owned or occupied by him. Any own? er, or his agent, or oooupant of auy real estate, upon whose premises water is brought from the oity reservoir, shall pay suob sums for the use of water as may be assessed by tbo City Coun? cil; and an owner, or bis agout, or oo? oupant, failing to make a report of the hydrant or hydrants used by him or her, or by any tenant or oooupant on such premises, shall be liable te a One at tbe discretion of the Mayor. Seo. G. All persons who ahull enclose auy streets or parts of streets iu the oity of Columbia, by and with oonsent of the Council, shall pay an annual rent of $5 on any street, or part cf any street, so enclosed, or euch other price or sum as may be fixed and de? termined by tho Council; but each street, or part of street, so enclosed by the consent of Council, may at any time be opened by tho order of said Oounoil, anything to the contrary heroin notwithstanding. Sec. 7. That if any person or per MBIA, S. C, WEDNESDAY sons shall fail, neglect or refuse to muke a retnrn or returns to the City Assessor, on oatb, of his, her or their taxable property, on or before the 3lst day of January, 1875, (except as in this ordinance otherwise provided.) such person or persons shaii beussessed by the City Assessor for and on all bis, her or their taxable property, or other things taxed by this ordinance, accord iug to the best information he can ob? tain of the value of such taxable pro? perly or other things; and snob person or persona who ahull fail, neglect or refuse to muke a return or returns on aforesaid, or pay the tax thereon on or before the 15th of February next, shall be subject to, and pay, in addition to said tax, 10 per cent, thereon. And the said Clerk and Assessor is hereby required to assess, ooileot and receive the taxes and dues levied and imposed by this ordinance, and all arreare of former taxes or due.-, and make a re? turn thereof, as well us a return of all persons who shall fail to make a re turn and pay the tuxes herein and hereby imposed, ou the 1st day of May next, or as soon thereafter as may be practicable. Seo. 8. The said Assessor is hereby directed, iu assessing for taxation the amount of suies likely to be made by auy dealer during the year 1875, to as? sume, if, in his discretion, it would bo just so to do, as a basis of bis estimate, the amount of Biiob sales during the year 1874, according to the sworn re? turns thereof of tho said dealers. Seo. 9. That all returns of property, of every description, and of all other thiugs made by taxation a source, of revenue to the said city by this ordi? nance, shall be made upon tho oath of the tax-payer, which returns shall be made by filling out blank forms, to be furnished on application by the said Clerk and Treasurer, on or before the 31st day of January, 1875, except as in this ordinance otherwise provided; but that time may be extended by the Mayor and Aldermeu; and the said re? turns shall embrace every subject or object of taxation, whether held by, or pertaining to, the tax-payer, in his own right or in a fiduciary capacity. Seo. 10. That all persona who may commence a permanent business in the city of Columbia subsequent to the time fixed for making tax returns, pay? ing the city taxeB and procuring an? nual licenses, shall, after the lapse of one month from opening business, make returns to the City Clerk of the value of the stock and other property employed therein, and pay their taxes and licenses; the taxeu on the value of the said stock and other property to be charged for the full fiscal year, but the licenses to be paid in proportion to the remainder of the suid year: Provided, however, That all transient dealers shall pay their full annual li? censes to the olose thereof. Sec. 11. That it shall be, and it is hereby declared to be, the duty of the City Assessor iccsscEs s!! the property named in this ordioanoe for city taxa? tion at a reasonable valuation, aud the City Clerk and Treasurer to collect the taxes levied thereon, and the per cent, imposed upon all other things as sources from which a city revenue by this ordinance is directed or coutetc plated to be ruised, although not spe? cifically mentioned, according to the rates herein declared: Provided, how? ever. That every tax-payer shall have the right of appeal to the Mayor and to the Committee of Ways and Meuns from the assessment of the City Asses? sor for a revision thereof, in case he should thereby feel himself aggrieved. Seo. 12. That in oase it should be? come necessary to issue an execution against Ihe property of the defaulting tax-payer, and to sell thereunder his real property, in order to collect the taxes due by him, it shall be the duty of the Mayor, and he is hereby em? powered so to do, in order to put the purchaser thereof into immediate pos? session, to issue his wurrant of eject? ment against the owner, or against bis lessee or Lessees, or against uuy other person or persons who may be in pos? session thereof, and to place tho suid warrant in the hands of the Chief of Polioe, or any other ollieer whom be shall select, who ahull proceed without delay to execute the same, at the ex? pense and ooBts of the party or parties in default: Provided, That the owner of tho fee, his lessee or lessees, shall not be deprived of the use and posses? sion for a longer period than two yenrs from tbe day of sale. Seo. 13. That the Mayor and Alder? men shall issue execution uguinst each and every person or corporation who shall be reported by the City Clerk and Treasurer to have failed, neglected or refused to make returns or pay the taxes imposed by this ordinance with? in the time herein prescribed;*and all executions issued by the said Mayor and Aldermen shall have attached thereto tbe signatures of the Mayor aud City Clerk aud Treasurer and the seal of the oity of Columbia, in tbe name of which snob executions shall bo entitled. Sno. 14. That all executions which may bo issued to enforce the payment of taxes, fines and licenses by the said Mayor aud Aldermen, in conformity with the foregoing sootioo, shall be lodgod in the first instance in the of MORNING, JANUARY 20, 1 fice of the Sheriff of Richland County, end may be directed to the said Sheriff or to the Chief of Police, or other per? sons appointed by the said Mayor and Aldermen, to collect and receive the same with the costs. Sec 15. That the words "real pro? perty" and "roal estate," as nspd in this ordinance, shall be co-extonBivo in meaning with lands, tenements and hereditaments; the words ''pers?uul property," as herein need, includes money, goods, chattels, things in action and evidence? of debt; and the word "property" includes property, real and personal. Sec. 13. That the City Treasurer be empowered to receive coupons and puRied uccounis for uupuid taxes for 1873-74, except water tuxes and spe oiol interest.
