The following ordinance is pub? lished for the information of all tavern, store and shop-keepers within the limits of the cify of Columbia. The penalties therein prescribed for neglect or failure to comply with its provisions will attach on and after September 1 :f Am Obdinancb Regulating Weights amd Measures. Section 1. Be it ordained, by the Mayor and Aldermen of the eity of Co? lumbia, in Council assembled. That the Chief of Police shall take charge of and keep all such weights and mea? sures as shall be furnished and de? livered to him by the Mayor and AlderoMn, aft the stnuderd of weights aid moaeares for the city of Columbia; and no person shall hereafter, within the limit* Of tho said city, aee any steelyards, scales, weights or measures, or ether iaplenemfs need ia ascertain tog weights and quarititieR, (for tbe purpose of aeoertaifaiog the weights or meafmroa ofiany articles of merchan? dise .buoght, sold or bargained for,) which Hhall not have been,. within twelve' months next before buch ose, adjusted, corrected and approved by the r.aid Chief of Police*,'aod itshall be the duty of the said Chief of Police to adjust and compare with the stand? ards in his possession nil such weights and 'measure* as may be brought to himilfor that purpose; and tbe said Chief of Police shall Lix upon such weights und measures as he shall ad? just such mark or marks as he shall think will bfst answer the purpose of identifying tbe same; and shall, in the beet muouer in his power, by private memorandum or otherwise, preserve the date of auch adjustment. Sbo. 2. Amt be il further ordained. Thut it shall be the duty of the Chief of Police, ouce every twelve mouths, (or of tenor, it be shall think necessary*,) to visit the houses und Stores of every tavern, store or 'shop-keeper within the limits of tbo city of Columbia, for the purpose of adjusting uud correct? ing the weights and measures used iu the btisiuesB of such tavern, store or shop-keeper, and shall adjust und cor? rect the same; and hereafter no weights or measures shall be used within tho said city of Columbia, exaept such as have been approved and stamped or otherwise marked by Chief of Police. Seo. 3. Be it further ordained, That any penon suspecting that he has been injured or imposed upon in tbe weight ut measure of any article of merchandise, if he has the same in his possession, may carry the same to the Chief of Police, whose duty it shall be to ascertain the weight or measure thereof by the standard in his posses? sion; and if, upon Buch re-weighing or measuring, the party shall think him? self to have been imposed upon, and shall make complaint thereof to tbe Mayor or any one of the Aldermen, a warrant shall be issued, requiring the person or persons charged with the imposition to appear before the Mayor; and upon the return of said warrant, or as soon thereafter as may be, the said Mayor and Aldermen shall inves? tigate said complaint; aud if the same be found true, shall impose upon tho offending party such penalty as offend? ers are liable to for the breaches of this ordinance; and where the party complaiuiDg shall not be in possession of the said article of merchandise, he may make complaint to tbe said Mayor or any ono of tho Aldermen, who shall issue a warrant returnable and to be tried as aforesaid, and, on conviction, tbe offender shall suffer the penalty as aforesaid; and on such trials, the oath of tho patty aompluining, together with the testimony of the Chief of Po? lice, (when he shall have made such trial as aforesaid with the standard, and is of opinion there was such impo? sition,) shall be conclusive in support of such oharge, unless tho purty com? plained of shall produce tbe whole of tho implements used, and also the arti? cle weighed or measured, wheu the same shall be in his possession, and identify tbe same upon his oath, and thereby, or in eomo other way, satisfy the authority before whom the trial is had that be did not practice such im? position as was complained of. And tbe said Chief of Police shall have power, arid he is hereby authorized, at any time to go into any store or place of business, in the day time, and when such house or store shall be open, and then and there to examine the weights, ecales, steelyards and measures at saoh house or store, and to adjust the same; and wheu the said Chief of Police, at such occasional visits, shall find that tho weights, scales, steelyards or measures, at any such place, have not been adjusted within tbe time prescribed, or have been altered since the last adjustment thereof by him, the said Chief of Po? lice shall make report to the Mayor or one of the Aldermen, who may order hq investigation thereof, and shall thereupon issue a warrant, requiring the person complained of to appear before the said Mayor and Aldermen to answer to the oharge; and any per? son convioted of such intentional alteration shall be liable to the penalty inflicted for the breaches of this ordi? nance. Sbo. 4. Be it further ordained, That if any person shall, by force or violeut and threatening language, attempt to hinder, prevent or obstruct tbe said Chief of Police in thu peaceable per? formance of tbe duties prescribed by this ordinance, such person, on con viotiou, shall suffer such penalty as is indicted for other breaches of this ordinance. Sec. 5. He. it further ordained, That any person offending against any of the provisions of this ordinance shall be liable to such penalty uu the Mayor and Alderman may inflict, not exceed? ing the mi in of forty dollars, for each aud every offence. Sec. G. Be it further ordained. That the said Chief of Police shall be enti? tled to receive for marking euch weight or measure, five cents, to be paid by tho owner of such weight or measure, before ho or she shall be per? mitted to make use of such weight or moasnro: Provided, That when there is more than ono weight or measure of the sumo kind stamped for th? -ame person, oach of such additional a . .tjUts or moasares shall bo stamped r?t two aud a half cents.
