Emau gave the necessary security, and appealed from that decision. Judge MaoArthur, yesterday, after reviewing all the circum? stances in the ease and the4aw bearing thereon, said that tho proprietor of a hotel restaurant was tbe proper judge of who should have either refreshments or lodgiDgs in his house, and no one could dispute.his authority in that matter. Whereas, by an Aot of tbo General Assem? bly of the said StatO, eutitled "An Act to au? thorize the Mayor and Aldermen of the city of Columbia to iaauo bonds and to negotiate aud soli tbe same," approved March 18.1872, tho said Mayor and Aldermen aro authorized to borrow money by leaning bonds of tho oity, from time to timo, to an amount whioh, toge? ther With the outstanding indebtedness of the city, .shall not exceed tho eum of $600,009; and whoroas, the said Mayor and Aldermen havocausodto bo prepared for issuo, uuder the provisions of said Act, certain coupon bonds of tho city, to the aggregato amount of $200,000, which they are now dobirous to sell and negotiate for tbo nses and purposes of tho said city; and wbereaa, it is considered that it will tend to enhance the valao of eaid bonds in the markets that certain definite ar? rangements shall he entered into before tho sale of eaid bonds, whereby to secure tho punctual payments by the city of tho semi? annual interest of said bonds and the re? demption of tho said bonds at maturity; and whereas, the Carolina National Dank of Co? lumbia is willing to accept certain trusts in reference thereto, and on the basis of such trusts to aid tho City Council in tho negotia? tion of tho eaid bonds. And it is hereby further agreed between the said Carolina Na? tional Bank and the City Council of Columbia, that if the necessities of the ohy shall so re? quire, tho City Oonnoil shall be at liberty to draw from the said bank mich amount or amounts not exceeding $26.000 of the "con? structive found" of $66.000, aa they- may re? quire, upon tbo substitution for the amount or amounts ao drawn of I ho obligation or obliga? tions of the city, to refund the same to the bank from tho taxes collected for the year 1873, without interest; and the said "Tho Ca? rolina National Bank of Columbia" agrees, 1. That the said bank will, as trustee, ac? cept tho conveyance of tbo City Hall building, and will rent out and leaeo the aame, from time to time, and keep tbe same rented out and leaned, on such terms aud for euoh pe? riods as may be moat advantageous to tbe in? terests of tho city, and will keep said bnilding adequately insured, paying from the rents thereof the expenses of insurance 2 And the said bsak further agrees to keep the amounts which shall be received for the rents of said building properly invested, as a sinking fund, for the final redemption of the ?aid bunds at maturity: Frooided, however, That if at any time tbo said bank sha 1 bo able to purchase any of said bonds before maturity, at valno less than the par value thr.reor, tho aaid bank shall be required to purchase the aame, and to cancel the boadB ao redeemed. 3. And the said bank further agrees, ra trustee, to receive from the City Treasurer all amounts which shall be paid to said bank on account of taxes levied aud collected to pay the interest on the said bonds, and td apply tho moneys so roceived to the payment of the Internat conpuns of the said bonds as the same shall, from time to time, mature and be presented to the said hank for payment; the said bank further agreeing to recoive /rou the' City Treasurer as caBh all coupona past due of said bonds which aball have been paid to said Treaaurer by tax-payers. 4. And tho said bank further agrees, that if in any year the amounts paid into the Hank from the receipts of taxes levied to pay aaid coupons shall exceed the amount requisite lor the payment of all coupons then dno, the excess of .such moneys shall, by the aaid bank, be passed to tho said sinking fund and invented therewith; subject, however, to be aftorwarda applied to meet any deficiency in any sncooeding year of taxation to meet tbe pajmont of the coupone of the yoar in whioh such deficiency shall occur. 5. Aud tho sail bank further agrees to mako to the City Council aeml-annoally, on the flrBt day of October and Apiil of each year, a report of the amounts received for reut and the amount iud condition of the sinking fond, and of all amounts received and ?aid out for construction of the new City [all, and of all amounts received from the collection of taxes, and tho amounts paid out in interost coupone, together with all other matters sa may be noceseary to inform the City Couucil of tho condition of tho said fanda. And it ia hereby atipnlated and agreed by and between the parties to;thia indenture, that all the covenants and agreements herein contained shall be mutually binding and en? forceable in law as covenant and agreement, moving between the aaid City Con eel 1 and the said Carolina National Bank.
