SECTION 1. Be it ordained, by th?
Mayor and if ie Aldermen of the city of Co?
lumbia, in Council assembled, That a
Board of Health be, and the same ia
hereby, established, which shall consist
of twelve members, to be chosen by bal?
lot by the City Council,'ut their first
meeting in May of each and every year;
and said Board shall be so chosen, that
three of them shall be elected from Ward
No. 1, three from Ward No. 2, three
from Ward No. 3, and three from Ward
No. 4, seven of whom shall constitute a
quorum; and if any person so elected a
member of the Board of Health, shall
refuse or neglect to perform the dntiee
hereafter required, he shall, upon con?
viction thereof before thc Oity Gonnoil,
forfeit and pay the sam of $45: Provided,
That no person shall be compelled to
serve more than one year in every three.
SEC. 2. Be il fur?ter ordained. That
the said Board of Health, of whom seven
f hall constitute a quorum, shall meet at
least once a fortnight from the first day
June to the first day of November of
eaoh and every year, and at such other
times and at such places as they may
deem necessary and convenient, for the
purpose of receiving and communicat?
ing all possible information relative to
the health of the oity, and to advise and
consult together respecting the preserva?
tion of the same; and shall have full and
ample powers to adopt and oarry into
effect all such measures, rules and regu?
lations as they may deem necessary to the
discharge of the trust hereby confided
to them; and eaoh and every practical
physician within the city is hereby re?
quired to give immediate information of
the existence of any contagious or malig?
nant disease to tho Board, or to any mem?
ber thereof, and at all convenient times
to aid and advise the said Board in the
preservation of the health of the oity,
and in the preservation or suppression
of contagions or malignant diseases.
SEO. 8, Be it further ordained, That it
shall be the duty of each and every
member of the said Board to canee to be
removed, from the streets within the
Ward undor his or their charge, all of?
fensive substances or nuisances tending
to endanger the health of the citizens of
the city; and the Chief of Police and bis
assistants, and the Superintendent of the
Streets, are hereby required, without de?
lay, to obey all orders or precepts that
shall be given them, or either of them,
by either of the members of said Board
respecting removal of such nuisances.
SEO. 4. Be ii further ordained, That
the said Board of Health, or any mem?
ber thereof, shall have power, and are
hereby invested with fall authority, to
enter into and upon any lot, ground or
possessions of any person or persons,
and thoroughly examine the same; and
whenever the said Board, or any mem?
ber thereof, shall have cause to suspect
that any foal or noxions eflluvia origi?
nates, or is collected in any honse, cel?
lar, or in any enclosure whatever, shut
np from public view, they, or any of
them, may demand entry therein, and
direct the same to be opened and venti?
lated, or tho cause of snoh effluvia to be
removed, as may bo deemed necessary;
and if the owner or occupant of each
lot, honse, cellar or enclosure shall refuse
or delay to open the same, or suffer it to
be examined and ventilated, or removed,
os aforesaid, or shall in any wise ob?
struct tho said Board, or any member
thereof, or any policeman or other officer,
in discharge of his or their official duty,
snoh owner or occupant shall be fined
not exceeding twenty dollars for each
and every day he, she or they shall so
negleot, refuse or delay, after demand by
said Board, or any member thereof; and
shall also defray all expenses incurred in
the removal or suppression of such nui?
sances, under the direction of said
Board, or any member thereof.
SEC. 5. Be it further ordained, That it
shall be the daty of the City Clerk to
act as derk of the said Board of Health.
SEC. 6. Be it further ordained, That it
shall be the doty of tho Chief of Police,
or aoting Chief of Police, to make dili?
gent inquiry as to all nuisances which
may exist within the city; to receive all
complaints which may bo made to him
concerning the same, and to report im?
mediately to any member or members o?
the Board of Health having charge of
the Ward in which such nuisance ex?
ists; and it shall be the daty of tho said
Chief of Police, or aoting Chief of Po?
lice, to attend the meetings of the Board
of Health when required, and obey such
instructions as said Board of Health
may give relative to the health of the city
SEC. 7. Be it further ordained. That
the Chief of Police, or acting Chief of
Police, shall have power, and is hereby
authorized and required, to demand
entrance into any lot, building, cellar or
enclosure, wherein he may suspect any
nuisance to exist, for the purpose ol
ascertaining whether any such nuisance
does exist therein ; and if the owner oi
occupant of any such lot, building,
collar or enclosure shall refuse to permit
said Chief of Police, or acting Chief ol
Police, so to enter for the purpose afore?
said, or shall otherwise obstruct or hindei
him in the discharge of the above dnty,
snob owner or occupant shall forfeit and
pay for eaoh and every offence a sum nol
exceeding twenty dollars.
SEC. 8. Be it further ordained, Thai
