SECTION 1. Be il ordained, by the Mayor and the Aldermen of the city of Co? lumbia, in Council assembled. That a Board of Henlth be, and the same is hereby, established, which shall ooDsist of twelve members, to be chosen by bal? lot by the City Council/at their first meetiog io May of eaoh and every year; and said Board shall be so choeeu, that three of them shall be elected from Ward No. 1, three from Ward No. 2, three from Ward No. S, and three from Ward No. 4, seven of whom shall conetitnte a quorum; nod if any person so elected a member of tho Board of Health, shall reface or neglect to perform the dutiee hereafter required, he shall, upon con? viction thereof before the City Connoil, forfeit and pay the sum of 8?5: Provided, That no person shall be compelled to Borve more than one year in every three. SEO. 2. Be it further ordaitied. That the said Board of Health, of whom seven shall constitute a qnorum, shall meat at least once a fortnight from the first day June to the first day of November of each and every year, and at such other times and at such places as they may deem necessary nnd convenient, for the purpose of receiving and communicat? ing all possible information relutivo to the health of the city, and to advise aud consult together respecting the preserva? tion of the same; and shall have full and ample powers to adopt and carry into effect all such measures, rules and regu? lations as they may deem necessary to the discharge of the trust hereby confided to them; and eaoh and every practical physician within the city IB hereby re? quired to give immediate information of the existence of any contagious or malig? nant disease to the Board, or to any mem? ber thereof, and at all convenient times to aid and advise the said Board in the preservation of the health of the city, and in the preservation or suppression of contagious or malignant diseases. SEO. 3. Be it further ordained, That it shall be the duty of each and every member of the said Board to causo to be removed, from the streets within the Ward under his or their charge, all of? fensive substances or nuisances tending to endanger the health of the citizens of the oity; and the Chief of Police and his assistants, and the Superintendent of the Streets, are hereby required, without de? lay, to obey all orders or precepts that shall be given them, or either of them, by either of the members of said Board respecting removal of such nuisances. 8EO. 4. Be ii further ordained, That the said Board of Health, or any mem? ber thereof, shall have power, and are hereby invested with full authority, to enter into and upon any lot, ground or possessions of any person or persons, and thoroughly examine the same; and whenever the said Board, or any mem? ber thereof, shall have cause to suspect that any loni or noxions effluvia origi? nates, or is oolleoted in any house, cel? lar, or in any enolosure whatever, shut up from publio view, they, or any of them, may demand entry therein, and direct the samo to be opened and venti? lated, or the canse of such effluvia to be removed, as may be deemed necessary; and if the owner or occupant of such lot, house, cellar or enclosure shall refuse or delay to open the same, or suffer it to be examined and ventilated, or removed, as aforesaid, or shall in any wise ob? struct the said Board, or any member thereof, or any policeman or other officer, in discharge of his or their official duty, such owner or occupant shall be fined not exceeding twenty dollars for each and every day he, shu or they shall so neglect, refuse or delay, after demand by said Board, or any member thereof; and shall also defray all expenses incurred in the removal or suppression of such nui? sances, under the direction of said Board, or any member thereof. SEO. 5. Be it further ordained, Thnt it shall be the daty of the City Clerk to sot as derk of the said Board of Health. SEO. G. Be it further ordained, That it shall be the duty of the Chief of Police, or acting Chief of Police, to make dili? gent inquiry as to all nuisances whioh may exist within the city; to receive all complaints which may be made to him concerning the same, and to report im? mediately to any member or members of the Board of Health having charge of the Ward in which such nuisance ex? ists; and it shall be the duty of the said Chief of Police, or aoting Chief of Po? lice, to attend the meetings of the Board of Health when required, and obey snob iustrnotions as said Board of Health may give relative to the health of the city SEO. ?. Be it further ordained, That the Chief of Police, or acting Chief of Police, shall have power, and is hereby authorised and required, to demand entrance into any lot, building, cellar or enclosure, wherein be may suspect any nuisance to exist, for the pnrpose of ascertaining whether any such nuisance docs exist therein; and if the owner or occupant of any such lot, building, cellar or enolosure shall refuse to permit said Chief of Police, or acting Chief of Police, so to enter for the pnrpose afore? said, or shall otherwise obstruct or hinder him in the discharge of the above duty, snob owner or occupant shall forfeit and pay for each and every offence a sum not exceeding twenty dollars. SEO. 8. Be it further ordained, That the second section of an ordinance, passed on the lGth day of April, A. D. 1851, entitled "An ordinance to esta? blish a Board of Health," be so amended as to require that every physician in the city of Columbia shall report to the said Board of Health, within twenty-foui hours, tbs occurrence of any case ol contagions or malignant disease in hit practice, under a penalty of ten dol?an for eaoh and every case whioh he shall negleot, within twenty-four hours aftei bis knowledge thereof, to report; said fine to be collected by information be' fore the Mayor, or any of the Aldermen, SEO. 9.
