Ordinance to Establish Board of Health.
SECTION 1. De it ordained, by the
Mayor and the Aldermen of the city of Co
lumbia, in Council assembled, That a
Board of ' Health be, and the same is
hereby, established, which ehall consist
of twelve members, to be chosen by bal?
lot by the City Counoil.'at their first
meeting io May of eaoh and every year;
and said Board shall be so chosen, that
three of them ehatl be elected from Ward
No. 1, three from Ward No. 2, three
from Ward Mo. 8, and three from Ward
No. 4, seven of whom shall constitute a
quorum ; and if any person BO eleoted a
member of the Board of Health, Bhall
refuse or negleot to perform the dutiee
hereafter required, he Bhall, upon con?
viction thereof before the City Gounoil,
forfeit and pay tho sum of $45: Provided,
That no person shall be compelled to
serve more than one year in every three.
Sfco. 2. De it further ordained. That
the said Board of Health, of whom seven
shall constitute a quorum, shell meet ot
least once a fortnight from the first day
June to the first day of November of
each and every year, and at such other
times and at such places as they may
deem necessary and convenient, for the
purpose of receiving and communicat?
ing all possible information relativo to
the health of the city, and to advise and
consult together respecting the preserva?
tion of the same; and shall have full and
ample powers to adopt and carry into
effect all such measures, rules and regu?
lations as they may deem necessary to t he
discharge .ot the trust hereby confided
to them; and each and every praotioal
physician within the oity is hereby re?
quired to give immediate information of
the existence of any contagious or malig?
nant disease to the Board, or to any mem?
ber thereof, and at all convenient times
to aid and advise the said Board in the
preservation of the health of the city,
and in the preservation or suppression
of contagious or malignant diseases.
Ssa. 3. De it further ordained, That it
shall be the duty of each and every
member of the Baid Board to cause to be
removed, from the streets within the
Ward under his or their charge, all of?
fensive substances or nuisances tending
to endanger the health of the citizens of
the city; and the Chief of Police and his
assistants, and the Superintendent of the
Streets, are hereby required, without de?
lay, to obey all orders or precepts that
shall be given them, or either of them,
by either of the members of Baid Board
respecting removal of euch nuisances.
SEO. 4Z. De il further ordained, That
the said Board of Health, or any mem?
ber thereof, shall have power, and are
hereby invested with full authority, to
enter into and upon any lot, ground or
possessions of any person or persons,
and thoroughly examine the same; and
whenever the said Board, or any mem?
ber thereof, shall have cause to suspect
that any foul or noxious effluvia origi?
nates, or is collected in any house, cel?
lar, or in any enclosure whatever, shut
up from public view, they, or any of
them, may demand entry therein, and
direct the samo to be opened and venti?
lated, or the cause of such effluvia to bc
removed, as maybe deemed necessary;
and if the owner or occupant of such
lot, honse, cellarer enclosure shall ref UKO
or delay to open the same, or suffer it to
be examined and ventilated, or removed,
as aforesaid, or shall in any wise ob?
struct the said Board, or any member
thereof, or any policeman or other officer,
in discharge of his or their official duty,
such owner or occupant shall be fined
not exoeeding twenty dollars for each
and every day he, she or they shall BO
neglect, refuse or delay, after demand by
said Board, or any member theroof; and
shall also defray all expenses incurred in
the removal or suppression of such nui?
sances, under the direction of said
Board, or any member thereof.
SEO. 5. De it further ordained, That it
shall be the duty of the City Clerk to
act as clerk of the Baid Board of Health.
SEO. 6. De it further ordained, That it
shall be the duty of the Chief of Police,
or acting Chief of Police, to make dili?
gent ' inquiry os to all nuisances which
may exist within the city; to receive all
complaints which may be made to bim
concerning the same, and to report im?
mediately to any member or members of
the Board of Health having charge of
the Ward in which such nuisance ex?
ists; and it shall be the duty of the said
Ghief of Police, or acting Chief of Po?
lice, to altead the meetings of the Board
of Health when required, and obey such
instructions as said Board of Health
may give relative to the health of the city
Ssc. 7. De it further ordained, That
the Chief of Police, or acting Chief of
Police, shall have power, and is hereby
authorized and required, to demand
entrance into any lot, building, cellar or
enoloBure, wherein be may suspect any
nuisance to exist, for the purpose of
ascertaining whether any such nuisance
does exist therein; and if tho owner or
occupant of any such lot, building,
cellar or enclosure Bhall refuse to permit
said Chief of Polioo, or acting Chief of
Police, so to enter for tho purpose afore?
said,, or shall otherwise obntruot or hinder
him in the disohargo of the above duty,
such owner or oe JU pant ahull forfeit and
pay for each and every offenoe a sum not
exceeding twenty dollars.
SEO. 8. De it further ordained, That
the Recond section of an ordinanoo,
passed on the 10th day of April, A. D.
1801, entitled "An ordinance to esta?
blish a Board of Health," be so amended
as to require that every physician in tho
oity of Columbia shall report to the said
Board of Health, within twenty-four
hours, the occurrence of any caso of
contagious or malignant disease in his
practice, under a penalty of ten dollars
for each and every caso which ho Bhall
neglect, within twenty-four hours ofter
his knowledgo thereof, to report; said
fine to bo collected by information bo
fore tho Mayor, or any of tho Aldermen.
SEC. 9. De it further ordained, That
thin ordinance Bhall tu kc effect from and
after its ratification, and that all ordi?
nances heretofore of force repugnant to
this ordinance be rt pealed.
